I reckon it's NOT a legal requirement but a recommendation and that's the reason it's never been checked.

Well that's what my limited research shows (only legal requirement on commercial vehicles)

UK about 70m people and Portugal about 10m.

I know of the situation of which you mention, it appears to be a bit of a grey area, afaiu you declare only 15% as the balance is considered a return of capital, so you may have grasped the wrong end...
