As far my little knowledge on this I think you can do it but you will need stamp next time you leave US and tries to enter again.

With AOS I mean getting new E3/H1 employer and transferring my pending H1 to new employer i.e. changing from B2 --> E3 or H1

No illegal stuff just want to follow pure immigration rules.

Sorry mate didn't exactly get you.

If you mean why can't I apply for GC now then She can apply now but it will take another atleast 5 years to get that approved.

Wife already got Aus spouse...

Wife already with me in Aus.

Long term plan is to settle in USA so moving wife to Australia will be a temporary solution and also put her GC in jeopardy.

Yeah you are right, but just want to keep that option as the last one since it will take atleast 5 years to get one.

All door looks closed.. since working visa has been denied and will get possible rejection for B2 visa.

Atleast better to have one application under process rather then none, that's why haven't withdraw h1 application.

B2 will be for short time pleasure purpose.

She is planning to enter as PR and I will be accompanying her as VWP or on tourist visa if ESTA ask to take visa. Not sure whether it's good idea to enter together but current plan is to do that.
