Re: I don’t ask for advice often, but…(CGT again)

Question. When declaring worldwide income for the tax year CGT was made and my UK income was say £20k April-April, would the PT accept this or would they force me to declare income between Jan-Jan...

Re: 90/180 day rule travelling with EU spouse

Appreciate your response but my wife returns after I week ! No question of overstaying in theory or practice. My query is how does the EES resolve a FOM manual border check on arrival.

Re: 90/180 day rule travelling with EU spouse

Thanks all for your inputs. Most informative and very clear now on the process. One Q with the EES, if anyone knows.

My wife UK 3rd country accompanies me, EU citizen into Portugal or...

GrahamF. We are both UK residents and wish to remain so. We love coming to Portugal but our home and kids are in the UK. Thx for the headsup.

Re: 90/180 day rule travelling with EU spouse

Thanks DLC. Given the presentation of wedding certificate takes care of the 90/180 rule as you say, will the Border official still require my wife’s UK passport stamped ie can my wife insist for it...

Re: More on EES Border Control

GrahamF. Thx for your account, the Lisbon Border certainly have a haphazard process. So in theory if the manual scan by the official shows the history, they can calculate how many days in the last...

Re: More on EES Border Control

Many thanks EU.flag. Your URL is most helpful especially as it has an English & Portuguese language so I can show the Border Control who is thus compelled to understand the rules and show them our...

Re: 90/180 day rule travelling with EU spouse

Thanks. But I am only interested in the 90/180 day rule….not the after 90 day rule you have to register. The latter is for EU citizens in the Freedom of Movement rule who travel to another EU...

Re: More on EES Border Control

Thanks for the last 2 posts. I am not sure why you think I am giving a confused account. I completely understand the Schengen vs FOM rules. I am not concerned with the latter as I know we will never...

Re: More on EES Border Control

Thanks EUflag. 2 q’s.

a. As partner of EU citizen, and only when traveling with partner, she is covered under free movement.

So how do I as a EU spouse with her (without residency) do I tackle...

Re: More on EES Border Control

Thanks. Seems a lazy reply from the authorities. It’s obvious that with residency the 90 day rule is exempted. But the issue is when travelling/joining a EU spouse. Net on the face of it, PT state...

My wife and I visit Portugal frequently from the UK. We are both UK nationals/residents and I have a EU passport too. Our travels plans for later this year will mean she is a few days over the 90/180...

Re: More on EES Border Control

Thanks Lou71, yes I have the reply from Europe Direct as below. It clearly says my wife is not bound by the 90 day rule as long as she travels with me. However The Faro Border Control has the final...

More on EES Border Control

Now I have a EU passport as well as UK one, my UK spouse is still worried about her 90/180 day stay and she will be over by a few days towards the end of this year with our planned stays. So we...

Re: Visa application assistance

I have no reason to doubt you. However the EU statement per my other thread states…During their first 3 months in your host country, your family members who are not EU nationals cannot be required to...

Re: Visa application assistance

If I were in the OP shoes, I would go to the Camara ‘register’ myself, they might give further advice too, then go online and get an appointment with SEF and just sit tight to the appt date. You have...

Re: Visa application assistance

In the absence of a SEF visit, no harm in going to your local town hall/camara and declaring your registration and see what comes of it.

Re: New EES system 2023

Ok. For clarity you are right. Let me rephrase my comment. 3 months stay is the max for an EU person without registering. I am not suggesting that EU nationals cannot stay for longer. It goes...

Re: CGT on sale of property

Ok 3 things to consider.

We declared our gain to PT last year. This was based on 28% of 100% gain. We now know this was an overcharge and are now applying to reduce this by half.

The CGT in PT...

Re: New EES system 2023

Re: New EES system 2023

Discussion has gone a tangent. We understand the 183 day implication. Just wanted to understand when the 3 month stay resets to 0 when leaving PT. I have emailed Europe Direct and will revert. Thanks.
