Always welcome. We are now telling our employees to file the EAD/AP 9 months before it becomes due, as they are now taking around 8 months to process. Whilst the employment part of the card continues...

Honestly, I wouldn't worry about it. I've actually got an employee who had a interview for his I485 in August last year (that actual interview) and still no news. USCIS is now completely broken.

You can also try going to Deferred Inspection and tell them you have a new passport and would like to extend your E3/D. They may allow it, but most likely you need to make a trip up-to canada or...

We just did a EB-3 Other Worker (unskilled) and from first ad placement to green card issued was 22 months.

NO RFE's or issues, just straight through processing.

I140 is the company.. It has nothing to do specifically with you so wont affect your renewal.

It's the I485 that makes life a little more tricky, but honestly once you have lodged the I485, you...

2. DHS HQ Washington DC

1. You can change status in the USA via an AOS, but expect that to take around 7 months before your spouse can work, so for E3 visa change then status change at the border, I would suggest going up...

Given the LCA will say Public Relations Specialists, just get them to put that in the cover letter for the job. It's not wrong because that's what the LCA will say.

You can apply for a new LCA with the correct details, but you shouldn't need to get a new E3 visa as it's still the same company and the same location.

It sounds like your going through AOS (Adjustment of status) and that can take a crazy amount of time. Whilst your in the country with a pending AOS, you are not accruing "illegal time" as you are...

Actually, they will do it based on her I-94 timeline as you can come and go outside the country as well and it would change the I-94 each time.

I've actually had somebody have this exact problem,...

Interesting situation that I'm certain the lawyers will solve, but one I thought I would bring it up here to get people's viewpoint on it.

An employee (E3 visa holder) is going through AOS...

You can always take the LCA outside the country and get a new E3 Visa... Be aware that doing it inside the country means as soon as you leave, you will need to front up to an embassy anyway to get a...

You could also once the company lodges the I140 also lodge the I485 (if current) as a concurrent process, then both of you will be able to apply for a EAD/AP card which will allow you to work with...

Your VISA is a ticket into the front door, the LCA the bit that allows you to work. Your old LCA is still valid, so you can still work on your old LCA whilst being granted E3 status upon entry into...
