A financial liability? that's what the affidavit of support is for, The US citizen must have sufficient income to be a financial sponsor for the person receiving the visa.

So was he able to AOS? You said that in order to file the waiver you must be eligible for adjustment, so isn't that a catch 22?

So let me get this right, Brian used someone's identification to enter the US he should be able to AOS?
He knowingly used someone else's information, how is this ok?
