Ex denies there is anything wrong with my son - like he knows from visiting 1/2 times per year.
I am concentrating on the whole visa thing now - it gives me time with my son to sort things out...

Hi Mr F - my son has consistantly changed his mind over the last year. Compounded with this, he has been diagnosed as having ADD, possibly Asperger's but my ex has managed to stop the full diagnosis...

Also Mr F, yes I married him and was married for some 16 years but he was living and working in the UK and is British so I certainly did not choose a situation where my children would hardly ever see...

Hi - my ex did not try to 'talk', just went straight for the legal route. He only comes over to the UK for the various court cases - skimming in day before and leaving on the next day, occasionally...

Thanks - I'm really pleased. US embassy gave me an email address when I rang and they came up trumps - I'm impressed with the US embassy. Also sent info to NY consulate and UK embassy in washington...

More good news! Had the following response from the US embassy :

' If your husband wishes for your son to reside permanently in the United States, then he would need to apply for an immigrant visa...

yes, Judge was pretty shrewd! I provided him with printouts from US embassy site and he demanded clarification from the embassy, so good result.

Hi - have already done that, sent a letter last week. i am also sending it to the British Embassy in Washington and Consulate in NY! In for a penny, in for a pound as we Brits say!!

thanks for that - I take your point that people do enter the US on a VWP and then apply to stay but they should not do this and a UK court should not be allowing this as the method my son should use...
