I think its 30 days but I am no expert. Also you can get H1b stamped in canada, shouldnt be a problem ...if you take the right papers. And yes they may easily stop you for entering US i.e. US...

As according to you, backround checks are initiated normally after a interview waiver, then whats the logic in saying that it takes 3-12+ months after the medicals to get PR papers....
