It must be even worse to hear the defendant's lawyer spout such nonsense too... and not be sure if the judge agrees with it or not. In GB courts, that kind of reasoning would be rightly laughed at. "oh, so you admit to driving and not being in control of a dangerous vehicle now... oh-kay, I'll just add that onto the list!"
