His issue was that his tenancy contract was due for renewal in a few weeks and he didn't know what to do. Bank doesn't own the apartment yet, so they can't sign a renewed contract. A few posters responded by saying he'd hit the jackpot by having free accommodation till the bank took over the apartment, while RERA apparently told him to leave his next rental cheques with them for the new owners to collect.

My guess is what happened with your mate is that he knew his apartment was in foreclosure and thought he struck gold with the idea that it would take forever for the bank to sort it out so he had "free" rent for a while. So he never bothered to renew the contract or leave a cheque with RERA for the bank when they ultimately took the apartment. And he came home one day and discovered that the repossession happened a lot quicker than anticipated and boom, locks were changed. And he doesn't have a leg to stand on for he was effectively a squatter.

Could be wrong, of course, but methinks this is what happened.

Let me try and elaborate a little - the company has paid for the apartment, his lease runs from Apr16-Mar17 and the company paid for the full year, along with deposit and comms all in one go (via bank transfer) and all to the agent.
I just found out although he has a signed lease agreement, the signature doesn't appear to be of the landlord (the courts/bank have specimen signatures of the landlord) and so I guess this in itself renders the contract invalid. In addition even though he registered with Ejari the name on the Ejari does not correspond with the name given on the lease agreement and so again a complete cock up.
Apparently the landlord brought the property 4 years ago, paid the minimum deposit and got the rest on mortgage. He has since made no mortgage repayments throughout the last 4 years and has been renting out the apartment and pocketing the rent. It's taken the bank almost 4 years to get the foreclosure on the property - I have no idea if this is even remotely true, but it's what my other colleague told me who has been accompanying the colleague who has been evicted to the courts. The other colleague is Arabic and hence being accompany the colleague who has been evicted since his a white brit dude, and would get nowhere in court without speaking Arabic.
I have no doubt that he should have at least received some kind of notification either in the post or via courier but he is saying he hasn't.
This is definitely a lesson in making sure you do thorough checks when leasing a property be it commercial or residential.

the latest is the courts have granted him 2 days (tomorrow and thurs) access to the apartment so that he can collect his stuff. A bank official will accompany the moving out and he has to prove that whatever he takes from the apartment is his eg show receipts for all the furniture etc

Who keeps receipts for furniture ffs?

You can see it now, "Where is the receipt for that cactus"?

what a d1ck move by the judge!
and you say the arab guy was there to 'help' negotiate the terms? I wonder what would have happened had he not been there..he probably would have to leave 'someone' behind....yanni!

I have receipts for all the furniture I have brought (I bin the receipts once the furniture has been binned) along with all jewellery receipts (real jewellery that is)

I wouldn't know where the receipts for big ticket items are...surely the guys contract says 'unfurnished' therefore it's reasonable to expect that everything in there is his?

actually he didn't even get 2 days....he had to go to court today again and was granted 3 hrs access to the apartment to remove his things.
