Under the letter of the law, it was a fair decision if a little perverse.

Trulli went off track, Hamilton was therefore within his rights to overtake him and rightfully gained 3rd place because when a car is off the track it is not deemed to be "in the race" and may be overtaken.

The team's mistake was then to instruct him to let Trulli past - the racing regulations state that when the safety car is out a driver must not deliberately slow down. Trulli thought Hamilton had problems with his car and went past him - this is also allowed under the regulations.

There is nothing in the regulations about "giving a place back" which is what the radio transcript reveals the team told Hamilton to do.

It was McLaren's mistake and they are not appealing it.

But the reports imply that the disqualification is because LH spoke with forked tongue at the hearing or whatever...rather than simply a rule infringement.

He may well have done - the FIA will publish the transcripts of what he said in the hearing.

Whatever, he and McLaren were in the wrong - there is nothing in the rules about "giving a place back". It was a cock-up whether he lied or not.

It's not that conclusive - at the time that they said let him through Lewis had not said that he'd already passed him... They did try to contact the race steward at the time.

It's a case of poor communication and confusion - there is nothing malicious or sneaky there.
