In the unhappy event of a death of a friend or a relative, the first thing to do is to notify the police. On arrival, the police will make a report and the body will be taken to a hospital, where a doctor will determine the cause of death. A post mortem examination/inquest is not normally performed, unless foul play is suspected or the death is a violent one. Contact the deceased’s embassy or consulate (see list on) for guidance.

The problem is Inse is that you can not stictly control anything in this country, you can give instructions, policies and procedures but you can bet 9/10 times they are not followed

If the school offers a bus service then they should be responsible for the running of the service

I read somewhere he had been off school for the previous 3 days to the incident which would I suppose have not made the teachers overly alert to the fact he didn't show up for class. Also when I read the article the other day it did cross my mind if he had been ill whether or not he was fully well and had maybe curled up and fell asleep on the bus (no excuse for not spotting him I know).

Maybe we should consider the possibility that he might have really been ill, and fell asleep/lost consciousness at the back of the bus, and went peacefully in his sleep?

The school shoudl have realised, true, and the driver could easily have ticked the kids off as they boarded and left the bus....

a friend of mine died suddenly out here and his wife wanted a post mortem for family reasons etc. They refused. The Doctor said he had died of natural causes, end of. We never found out what had caused his death and he was cremated here in Dubai. All bodies that return to the UK have post mortems conducted.

Knowing what you do now SYB about this tragic event-who should be charged and with what do you think?

Yes,a legal requirement-in the interests of Public Health.

A long time ago as a novice Law Graduate, I had the grim task of attending PM's, the most harrowing of which were SIDS(cot deaths) and battered babies. It appeared to me to be a major part of the bereavement process for the mother to know why-exactly- her child's life had been taken.
Life is precious and -for one as young and innocent as the wee fella's to be snuffed out-then someone must account. Clearly his Mom will never know.
In most legal systems- the decision to have a pm is for Crown Prosecution Service -this takes the 'right' away from the parent- so it seems harsh.
However,if a pm could pinpoint cause of death and if it was due to disease which may be incubating in a sibling then surely that gone unchecked to even more tragedy would compound the mother's grief?
Just my ramblings.....

Oh, I'm an engineer, not a lawyer, but here's the engineer's view of it:

a) A tragic loss of life has occurred - how do you prevent it from happening again?

b) Appoint some body (you're the lawyer, i don't know who the appropriate UAE body is) to investigate the cause and the current systems that created the event.

c) If the investigation highlights negligence by some party, prosecute and apply punitive measures as necessary.

d) More importantly than c), legislate to implement systems that ensure that the situation does not arise again.

Of course, engineers would also ground all the school buses until the process was complete, but hey, you can't have everything....

(a)&(b) cannot be resolved until the cause of death has been established.Cause of death cannot be established until (d) comes into being...i.e by which I mean legislate for FAI & PM's then (c) follows.

Oh, I have moved on from the legal profession.....I earn an honest crust now

in a totally different world.

In this case, even if there were, the child's remains have been sent back to India for whatever form of ceremony is applicable.

At the very least, one would expect that the government would react by setting up some kind of safeguards to improve supervision of kids on their way to school. The non-western kids in my block are completely unsupervised - i see them get off the bus and into the lift without any sign of mum or dad or ayah supervising. :curse:
