duty free limits from Gibraltar

Default duty free limits from Gibraltar

Hi Does anyone know how many cigarettes can be brought back from Gibraltar
to the UK? I know you can only bring back 200 cigarretes bought in
Gibraltar but what about cigarettes bought in an excursion into Spain. In
otherwords can you bring back 3800 bought in Spain plus the 200 you are
allowed to bring back from Gibralter?

Since Spain is EU as well as UK there is really no limit to the amount
of cigarrets you can buy since you pay VAT fully in Spain acquiring the
tobacco. Martin, I supopose you are a citzen of UK, or are you from any
other country ?

Spain is not Gibraltar.

Gibraltar is outside the EU. It is covered in the link I posted.
The rules aren't interested in where the tobacco was purchased
originally. What is important is in where you are arriving from.

But you're perfectly allowed to bring in what you've bought and paid tax for
in another EU country (here Spain)
From your HM Customs site:
"If you also have tobacco or alcohol goods that you bought in an EU country
(other than tobacco products over the limit for imports from that country)
you will not have to pay any more duty or tax on these so long as:

a.. they are for your own use and
b.. you can show, if we ask you to, that you have paid duty and tax in an
EU country, for example by producing the receipt."

e.. According to HM Customs a reasonable limit amount of tobacco for
personal use is 3200 cigarettes (there's a lower limit for the new EU
countries) so the o.p should be allowed to bring in 3200 cigarettes bought
in Spain and 200 taxfree bought in Gibraltar.

That is what I thought as well but it is not very clear as shown by the
other posters replies
When I go to Gibraltar I think it will be better to ask at the custom post,
that is if the wedding I am going to is still on.

What is wrong with sunny Scotland for a wedding anyway? :-)

It depends where you are flying back to the UK from.

If its Gibraltar, the legal limit into the UK is 200, it
does not matter where you buy them and the gibraltar duty
free shop at the airport is cheapest.

For the record its also illegal to be in possession of 2000
cigarettes in Gibraltar. This was done to prevent Spaniards
smuggling Gib>Spain.

HM Customs site says :
"When travelling from a non-EU country (including the Canary Islands, the
Channel islands and Gibraltar) you can bring the following into the UK for
your own use without paying UK tax or duty:
200 cigarettes; or 100 cigarillos; or 50 cigars; or 250g of tobacco "
"If you have any more than these allowances you must declare the goods in
the red channel or use the red point phone."

But also:
"If you also have tobacco or alcohol goods that you bought in an EU country
(other than tobacco products over the limit for imports from that country)
you will not have to pay any more duty or tax on these so long as:
they are for your own use and
you can show, if we ask you to, that you have paid duty and tax in an EU
country, for example by producing the receipt. "
