Default Advice from those in the Phillipines

Hi,


Without wishing to bore you.

I outsource a decent amount of work to this area, mostly data processing, a little seo and some calling.

I would like to set up an actual office in the Philippines and am prepared to come over and be there a lot, right now i am in italy but with no ties and been here a couple of years and want to go somewhere new.

Seems ideal

I only considered this last night but as far as decisions go, if i can see the pros and cons fast i will just jump in and do it.

I am not sure it will be Manilla, Cebu seems more likely

Really looking for an expats inside view on the legalities and legislation

If you are going to opporate from the Philippines you can only own 40% of a business. You would also need to consider the most appropriate visa as well as you can't work as a visitor.

No problem getting round that particular loophole
The business already exists its uk based and if that is the correct law for the phillipines I will simply offer a job to someone to set it up and they will be our employee and I will be visiting them.

40% sure that is accurate? seems very odd

If you follow the link in Patph's post you will see that the 40%-60% rule is true. You will also see that you can effectively buy your way around it by making a big enough investment. From memory the 60% ownership needs to be made up of at least 5 filipinos, don't be tempted to use ghost filipino as you will then fall foul of the anti-dummy corporation laws. Also you can't include a filipino wife as you would are considered a single family unit and still limited to 40%. The normal way around all this is to have the wife as 100% owner......but as a foriegner you may not be legally allowed to work for her and definetly not allowed a controlling influence.

What you have already read is true its 40 for you and 60 to the locals, there is talk that they want more foreign investment but until they allow more ownership
i think it will take years. Foreigners that are married can never own land. If you find a way around it, you take care as its almost certainly a scam
