Hello there,

My partner and I are currently looking into moving to NZ and all the documentation that is needed.
My ex husband who is father to my 2 children aged 10 and 15 is coming round to the idea that the children will have a better future in NZ.
I have rang the local County Court and they have informed me that I have to apply for a Residence order. My question is: If the Residence Order to approved (with consent from my ex) is this the only requirement I need to take my children out of the country?

What residence order do you have at the moment? I understand you can only go back to Court if there is a problem with residency.
Your ex-husband needs to sign a Statutory Declaration in front of his Solicitor stating that he gives permission for the children to accompany you. INZ only want to know that you have the right to take the children out of the UK.
I have had a lot of experience in this so if you would like to 'speak' via Private Message I will do what I can to explain things.

You need a document from emigrations that infront of a solicitor your children's dad signs saying you can take them then the solicitor signs and stamps it costs £10.00

I'm sorry. I don't understand. From what has been written here it does take a whole lot of much more. Can you clarify what you mean please?

You need a document signed by your kids dad with a solicitor as witness the solicitor also needs to sign and stamp the document

True, in the happy and simple world The Document is called a Statutory Declaration. Most times it's not quite so cut and dried.

also Solicitors may charge differently for signing/witnessing papers so don't bank on it actually being £10
