Question criminal record

Hi,
Can anyone offer any advice. My husband and I are getting ready to submit our EOI. I am a teacher and he is a manager. We have the points needed. The only problem is my husband has a criminal record. A 6 month prison sentence 12 years ago for assault after getting involved in a fracas while under the influence. It's obviously a very regrettable incident in his life. Does anyone know of anyone with similar experiences or can offer any advice.

As there is a prison sentence involved, I think you would be best advised to get an agent's advice. It may not be a definite "no" but the details would need to be presented in the most best way possible

From memory I think I saw jail terms of 5 years or more being an issue. Such a historic thing with such a short sentence hopefully should not be a problem. Check on NZIS's site. That.s where I saw the bit about five years.

I doubt it will be a problem. What will definitely be a problem will be if your husband doesn't declare it! Immigration people take a very dim view of trying to conceal these things.

Hi...my Police certificate only went back ten years...so i would imagine if the conviction was spent ten years ago, immigration could well not take it into account...but honesty is always best answer.

Not sure about how back the police checks go for emmigration go but i can assure you the Police National Computer (PNC) does not have any sort of weed date on it and convictions stay on record for good.

As someone else said best to just declare it and be up front about it.

As I understand it convictions are stepped down from PNC access level after 10 years. This is for minor offences. Three or more convictions the wait period is twenty years. Imprisonment for certain offences never come off the PNC. Any conviction for violence even if minor will stay on till your 99th birthday.
NZ immigration, if you have been in prison for 12 months or more you will need a waiver. If it is over ten years ago you should be ok.

Yes sorry should have said i meant serious convictions for criminal offences that result in a custodial sentence......
