british parents- child passport???

hi
we recently had a baby and he now has a kiwi passport because we have residency.
now my question is i want to get him an enlgish one so that when he does his oe etc he will have no problems etc...- i thought we could but someone told me yesterday that we have to have lived in england for 2 out of the past 3 years and not to have been out of the country for more than 270days!!
well thats us stuff it it is true. can anyone help please? because otherwise i will have to ring the premium rate number to find out :-(

The UK Border Agency here should tell you.

It looks like (assuming you were both British Citizens born in the UK), then your children (but not their children if born abroad), are British Citizens by descent. No qualifying periods et al mentioned that I can see....

We are in exactly the same situation and your baby is entitled to UK passport. We have got kiwi passport for our baby and as we shall be in UK next month will be getting her a UK one then. Just need her birth certificate with parents names and your or your partners, very easy.

if i get one when i am in blighty in 2 weeeks time- do i need to make an appointment? how long will it take? i am in england for 10days then france for 3 weeks.

Bear in mind the baby's status depends on how the parent gained their British Citizen status, if either of the parents was born outside the UK then that affects the baby's right to British citizenship so be wary of saying two cases are the same....

You should have said "may affect" rather than "affects" ... a subtle distinction but important. Only one parent needs to be a British citizen otherwise than by descent, noting that for children born before 1 July 2006, there are issues claiming British citizenship through an unmarried father.

Well corrected, incidentally is your reference to the correct information being held on a BE page rather than referring to an suitable agency page (as UKBA is in this case), a bit at odds with your signature???

Out of interest, who maintains the BE page to accurately reflect the legal position at all times??? (conundrum for all resources such as BE world-wide...)

Yeah your right it could be different I just presumed Lilycat was another pom living abroad like me didn't think about being a citizen by descent. Ok in my case both parents are named on our babies birth certificate and both of us are born and bred brits (many many generations) which means that if we present our daughters full birth certificate and either of our birth certificates and the form,photo and payment she can get a uk passport. So Lilycat if your situation is similar then you can get a passport. Not sure how long it takes but I think if you pay extra you can speed the process up.

hiya
yep we are poms living here and are poms from as far back as can be traced!
i will look into paying the extra- i reckon it could still be cheaper doing that and getting it when we are over there than the prices wellington charges!!! licence to print money that is!
thaks for all your replies i will do a it more digging and see whether we can do it when we are over there.

No worries lily, agree with you on Welly prices. Just been on UK website and read this :" A first child passport costs £49 for standard service and £96.50 for the one-week Fast Track service. The Premium service is not available."

In fairness it's a wiki page and therefore cannot be guaranteed to be correct (but it is ... last time I looked).

One should always check to an official source such as UKBA but do be aware that they can be wrong (1-2% of the time) and sometimes omit vital information (perhaps 20% of the time).
