Talking Wanting to Move to the UK

Alright, I'm going to try to work this forum out, it looks pretty neat so far!

Where to begin..

My husband and I got married the 5th of October, and had our baby on the 19th of October. We would like to move our son and I to the UK with him. His grandma has offered to let us stay with her until we can get on our feet, and she has a 4 bedroom house.
I've been reading on the UKBA website, and I know that since my husband is on DLA, it makes us exempt from the financial requirements on the spouse visa, but I'm having a hard time putting everything together and comprehending the site.

Could I have some advice on this pretty please??

Are you in the US? because if you are, you can get lots of help and info on www.uk-yankee.com too.
They have lots of UK/US marriages.

Hello Faithy,

Interesting in finding some else in the same boat as me with a disabled spouse. The only difference is my babies are 18 and 12! Congrats by the way.

I tried to wade through all the information and I've finally decided to just hire a Visa specialists. I spoke to many and with the new rules, got many varying answers. I found one I'm comfortable with and will use them when the time comes. For Sanity's sake that's my reccommendation. Good luck!

Presume your husband is a British citizen with British passport, in which case he needs to apply for a spouse visa for you.

Plenty of threads on this in this forum.

Presume you and hubby are living in the US, so, although you say that he is on DLA, is he actually registered and drawing DLA from the UK?

If not, I should imagine that this will affect whether or not you can apply under the DLA rules for the spouse visa.

If he is living the USA and still getting DLA he's committing benefit fraud and personally I wouldn't dare make an application for a visa in those circumstances.

If he was on DLA put stopped it to go to the US it wont matter for visa purposes, he'll need to meet the financial requirements.

He needs to be on DLA and have proof that he's getting it at the time of the application - it's in Appendix FM under E-ECP 3.3. The evidence required is specified in Appendix FM-SE to the rules

You can find further details on how the UKBA implement the rules in the IDIs - in particular http://www.ukba.homeoffice.gov.uk/si...df?view=Binary for a definition of adequate funds (at the level of income support plus housing costs).
