- You can support yourself and any dependants without help from public funds

And if he moves back there ahead of her and the children to first get a job and accomodation (a job that can support four people) - he'd now have a 10 year ban I believe, so if anything went wrong they could be separated...

I see. I didn't know any of the requirements, but you're right, it sounds like that will be just as difficult, if not more so.

For the OP, number one priority is finding a joint sponsor. Number two, find the funds to file hubby's AOS.

Hello all, life has been busy (it still is, I've got a lot going on right now :)),
but I wanted to drop in and say we are doing okay. My Father-in-Law is on
board with paying for our paperwork (I am eternally grateful :wub:), I am
looking for a job..all that good stuff. I have a quick question at the moment -

My husband ("J") wants to renew his passport since it expires in October..
we were wondering if anyone had advice as to how to go about doing so??

His passport expired in October..but his new one arrived so quickly that it was shocking.

I have another question..we keep getting told that he can't apply for a work permit yet, but is that true? SURELY you can as you go through the process?!

If, in addition to the I-485 that you filed to adjust his status, you also filed an I-765... then yes, he should get permission to work in about 90 days. He'll get a notice to appear for biometrics and after that he should get an Employment Authorization Document (EAD). Once he has an EAD, he can apply for a SS# and then get a job.

This is all dependent on whether or not the I-765 was filed. If it wasn't filed initially, then you can file now as long as you have a receipt indicating that the I-485 was filed. If the I-485 has not yet been filed, then he can not get an EAD. The EAD is dependent on the I-485.
