Default Returning to UK without work?

Hey guy's,

I'm looking to move back home in the next year with my US wife. I'm actually in the UK right now on vacation and it's great. Just as good as it was last year - Im convinced now after two vacations that I can live here happily.

I'm based in the USA (California) and have lived there for 7 years. I'm not sure how the funding works to get back and prove we wont be on the dole. We will be living here at my parents house. Will they still let us back on the basis we will find work...seems risky - do I have to find a job here first then move? It's not like I can fly over for a interview.

My wife was recently laid off in the US but i'm employed there full-time, I've been with the same company for 5 years.

Thanks for any help, I searched but became lost...

As far as I know, if you're a UK citizen (which I am guessing you are), they will let you back in whenever you like. Am guessing (again!) that your wife will need some kind of VISA/Permit though. Others will be along shortly to offer more than guess work!

Try uk-yankee.com for a forum dealing specifically with a US to UK move regarding visas, finances, housing etc.

If you have a decent amount of savings then you can get away without needing to show that you have a job there straight away.

This link will give you information about getting a visa for your wife.

Hey guy's. I got a response on this issue by a member on ukyankee. Please see below...is there anybody here who has moved back without a bankfull of money?

Response to my post above:

In order to sponsor someone you need to show proof of adequate Maintenance and accommodation. If you're going to be living with your parents then you'll be able to show accommodation by getting a copy of their deed or current mortgage statement and a letter from them describing the residence, the number of people currently living in the home (so to avoid overcrowding) and the terms of you residing there (ie if you're paying any rent or utilities during your stay).

But it seems you're going to have a bit of difficulty proving Maintenance for your wife. If at the time of her application if you are in the US in your current job or in the UK unemployed you will need to show adequate Savings (not retirement funds or investment accounts etc, but actual cash in either Checking or Savings accounts) in order to support your wife to the tune of the cost of your accommodation PLUS £100.95/wk for the foreseeable future once you and/or your wife arrives in the UK

reaction: $160 a week, $692 a month - $8000+ a year. This means I have to not only pay of my remainig debt here in the US but also find 8 Grand incase foreseeable future is that long...what if it's 5 years!

Only husbands sponsor wives - correct?

I feel so trapped right now, guess I'm stuck here unless I just come home get a job and apply...but as she got laid off we are relying on my wages to pay our bills.

Feel totally Ill.....I should never have moved!

I got this answer to my original post:

We have alot of people who have actually done this.

If you have any children, this amount increases £56.11/wk with EACH CHILD.

-------

I'm wondering has anybody done this without being rich, if foreseeable future is a year that's $8,000 I have to find on top of paying my US debt.

I could fly home and find work, work for a few months then apply for her BUT we are relying on my wages to get by - she has not got a job. It could take years of back n' forth paying bills here paying there.

Is it really this financially chalenging to come home. I feel so sick, i wish i had never ever moved here!

It's not only a husband who can sponsor a wife as I'm a wife (born in the UK) and I'm my husband's sponsor. We didn't want to go through the whole thing of staying with family on our return so I booked and paid for holiday cottage for two weeks and sent the confirmed reservation letter with my husbands spousal visa application and it was accepted. We weren't rich coming to the UK obviously with the exchange rate but we did have some proceeds from the sale of our house which we also included in the visa application form. Completing the form is very daunting but just include as much paperwork and information as possible.

Hi, here is my experience, hope this might help.

I and my British husband moved back to the UK earlier this year. We quitted our jobs in Australia and spend 2 months travelling after which he returned to N.Ireland (didn't have a job at a time)and I went to my home country where I applied for Spouse Visa in UK Visa Centre attaching copies of our birth certificates, passports, bank statements,my recent payslips, rental payment statement from my house in QLD and mortgage statement for my husband's house in N.Ireland (any proof of your financial credibility would help as a sponsored spouse is not eligible for public funds while on spouse visa, not sure about returning from outside of EU Brit resident ,think some restrictions apply as well) and an invitation letter from my husband. List of supporting docs might vary from one visa centre to another (I applied in Moscow one) however.
In overall you do not necessarily need to have a job while sponsoring your non EU spouse to come to UK but surely you need some proof that you can provide for yourselves.Good luck with your move!

You do not need to have a job at all. We have just moved back to UK. OH is from NZ and me Brit cit. Neither of us had a job to come back to, just had to show we had enough money to support ourselves until we did find work.

Depending on what sort of work you are looking for, be aware that if you need a CRB check to gain employment, make sure you have enough money to last at LEAST a couple of months as in some cases processing the checks takes forever!
