Hello, I have tried searching but haven't found this yet. Hoping someone knows the answer...

I am an Aus citizen, my husband is a UK citizen and became an Aus PR this year. We would like to move back to the UK but are concerned about holidays back here once his current travel authority expires.

Can he travel as a tourist on a standard ETA if we have no desire to resume residency or does he have to use an RRV even for short stays? I have a feeling he would have to use the RRV as he could stay indefinitely once in the country if he wanted to. But I am concerned that he would not be granted one as we will not meet the residency requirements. Will this be an issue even if we will only be staying for a few weeks at a time?

I have suggested to him that we stay here for another two years so he can be granted citizenship. This should also benefit my UK application (I was only a WHM previously so have to apply for settlement) as we would have been living together outside of the UK for four years so could qualify for ILR under the current rules. But he doesn't like that idea.

Use the RRV, always.

http://www.immi.gov.au/allforms/pdf/968i.pdf tells you how an RRV can be renewed. An Australian spouse is a "substantial tie".

Are you familiar with the new concession in section 22(9) of the Citizenship Act?

Thanks for that info. I thought he would need an RRV but didn't realise that having an Australian spouse was adequate to be eligible. The concession link was very interesting also, good to know he may still qualify for citizenship in a few years.
