going back..shannon imm experiences
 
Hi all , i am finally going back..its been just over 12 mths for me and im a little worried as to what i will be asked when i re-enter..im flying from Birmingham to Shannon and on to Atlanta. Its been a VERY hard 12 mths for my family and i , and i understand that that will probably mean jack xxxx to the POE officer! has anyone had any similar experiences ? IAN your advice please young man !

You might want to expand upon this a little as from what you have written we have no idea whatsoever as to your circumstances, or why you might possibly expect a hard time.

Hi Tonrob..basically we had a hard time ,or rather i did, to find continuity of work , we came back to England, didnt have the finaces to apply for the 2 yr pass etc. I have now been offered employ and am just concerned about getting in ..in a nutshell.I re-entered Englang June 17 2010 and am flying back next Sat .

So you've got a greencard?

Based on marriage?

Didn't get conditions removed and moved back to the UK?

And are wondering if you will be able to move back to the US?

Time for a lawyer.

Yes i have a green card..since 08..yes through marriage..and yes im going back.

Do you have a 10-year green card in hand?

If you've been out of the USA more than 12 continuous months, you can expect a hard time because you might have abandoned your PR status.

What have you done while outside the USA, to maintain your PR status in the USA, other than hold a green card?

You've been back in the UK for over 12 months?

Have you done anything to maintain your residence in the US? Kept a place, bank account, filed taxes etc?

Did you apply for a Re-entry permit before leaving?

Did you get a re-entry permit?

If not, how about a [EDIT: Returning Resident] visa? From travel.state.gov,
"A permanent resident (called lawful permanent resident or LPR) or conditional resident (CR) who has remained outside the U.S. for longer than one year, or beyond the validity period of a Re-entry Permit, will require a new immigrant visa to enter the U.S. and resume permanent residence."

I agree with Bob - have a consultation with a US immigration attorney to discuss your situation.

Have got a U.S. bank account..have filed taxes..have furniture etc in storage..just a victim of the economy basically, not an easy option when you have little funds to support yourself and 3 mouths to feed..so..i came back to work, and am now in a position to return .

I agree with the others, a consultation with an attorney is in order. You might need to look into the Returning Resident Visa.

That's good, don't have to worry whether you've removed conditions or not then.

So , do you think ill get back in Rene ? how do they know when i left ? i know all about flight manifests etc..but from previous experiences thts the ONLY possible record they have..isnt it ?

You'll get in. But you might be scheduled for an appointment with an immigration judge.
