A dependant visa which needs to be applied for at the same time as the spousal visa

Will you apply for British Citizenship for them later?

They will go through the same process as my husband. This is not the way I wanted to go but it is straight forward with them being adopted from overseas. I am still searching for an alternative way but I spoke with a immigration specialist and this is what he told me, after he reviewed all my info etc, cost $150 for the privilege

If they are on a dependent visa that will up the the amount of money you need to earn to be able to sponsor your husband and children won't it?
If they are UK citizens they don't count on the calculations and you only need to earn the £18,000 a year

Susie64,

That is very interesting, thank you for sharing. Sigh, it all sounds very complicated, I will have to make some time to have a good look at the online site and trawl all the forms.

If you apply for the spouse visa there is a section where you enter the information for your children. So why do you need to apply for another visa when you already have them on your settlement visa application. Of course if they are not British citizens you'll have to earn a few thousand more a year income.

I haven't even looked at the spousal application yet, we are not at that point until my husband gets his HPC approved and we sort out with our house over here. I don't want to work in the UK so will need the money from the sale of our house for the $675000 in an account for 6 months prior to moving

You were told what you needed to do to get them British citizenship in post #25 of this thread, including the relevant part of the Home Office Nationality Instructions:
http://britishexpats.com/forum/showt...=765799&page=2

If their adoptions are either in a designated country, or are Hague Convention compliant, and you have evidence of that, then it's not clear why you think there is a problem with applying now for them to be registered as British. The MN1 process is straightforward.

Or are you telling us you think the adoptions are not recognised under British law? In that case you will have more significant legal issues to resolve if you intend to move to the United Kingdom.

My daughter is not a problem she is on the list, a hague country (China) adopted after the dates it came into force, my son is the issue as he is from Ethiopia (not a designated country on the UK list).

So go ahead and submit an MN1 form for your daughter and when you look at the fees list, you will see it doesn't cost much more to submit an MN1 for your son at the same time. They have to consider the full circumstances of each case for this kind of citizenship registration.

You told us on a previous thread that your son was re-adopted in the United States, is that the case or not?
