Hi everyone!
I am currently working as a contractor (inside IR35) for a company that has an ongoing project in Saudi Arabia. I had been approved to relocate to SA, which means I will end my contract here in GB and start a new contract in SA. The hiring process with HR of my company takes a lot longer than expected with a lot of approval steps which had delayed my plan to start my contract by 6/4/25 (the beginning of the tax year). This has affected my Statutory Residence Test (SRT) due to the delay. I'm looking at Third automatic overseas test as this is the only option that would work for me (I have 3 ties for the "Sufficient ties test" so that would not be an option). There is a condition on the test that says: "the number of days on which you work for more than 3 hours in the UK is less than 31" and "there must be no significant break". Currently I'm still employed at 7.5h per day and 5 days per week. Do you think it would work if I approach my employer with a new hours schedule to fit the SRT test requirement? Like 3h,10h,10h,10h,3h from Mon to Fri instead. At least it would buy me some more time (10 weeks) for the visa process. I have read through the guidelines and don't see anything wrong with it but I am not 100% confident.
Any advice would be much appreciated.
