Default Wife in Mexico, US Soldier headed to Iraq

I wa wondering how I should go about trying to bring my wife
here to the States, BEFORE, I get shipped out to IRAQ, be it with a
VISA/pass or whatever. This wont happen until early next year, but
mind you its not like Im going to have a whole lot of time on my hands
as I will have training committments and such. While I am being
mobilized (preparing) for the Deployment, she wont be able to visit me
unless of course I get a pass or leave to visit her. Currently she
cant come over here for anything as she has no VISA/special
pass/whatever so I end up going down there. I would like to try to
make some sort of headway with this before I get going, I dont want to
be dealing with this when Im in a foxhole in IRAQ dealing with 'those'
guys. My wife could benefit a lot during my absence as far as medical
care and other matters are concerned just by virtue of her being my
wife and me being in the military. I would appreciate any advice on
this matter.

sincerely,

Soldier

Hi Jaime,
There should be a JAG on your base who is experienced in dealing with issues pertaining to immigration. It would be worth a consult. Good Luck.

SecretGarden's advise is a good one, you should consult a lawyer.

Having said that, I am the mexican wife of an american citizen and went through the k1 fiancee visa procedure to come to the United States, marry and apply for residency. You may be looking at a k3 wise visa procedure, which is a bit different, but if you need any information on documentation, the medical or the consulate interview, I'd be happy to help.

Good luck!

There isn't a lot, if anything, that you can do that will get her here in 4 months time. It would be virtually impossible for her to get a tourist visa from the US Consulate due to her strong motivation to migrate to the US due to marriage to a USC (I'm assuming you are one, although you don't say).

If you are a USC you can start the petitioning process by filing the I-130 for her and then when you get the first notice of action file the I-129F for her K-3 visa. But there is no way it would be finished before you left. Besides would you want her to live in the US away from all she is familiar with and her family while you are in Iraq?

You pretty much asked this same question over a week ago. Several folks gave you good advice - I guess you didn't get the answer you wanted.
