Default wife her on k3 eligible for social security no??

Hi group,

My wife is here in US on k3 visa. We have applied for AOS. is she
eligible for social security no??

Yes she is, but are you going to apply for an EAD for her?

Yes, if she has EAD. So, she has to apply for that.

I posted just the opposite of your advice. The K-3 does not have the inherent right to work for 90 days as the K-1 does and therefore, I have seen posted here that the only way a K-3 qualifies for a SS# is with an EAD.

Could someone clear up this question for me?

I didn't think your advice was conflicting Rete. Just presented differently.

Please forgive me if I am wrong but I believe that Cindy' advice was "Yes, ultimately, as a K-3 is entitled to apply for an EAD but you need an EAD before you can get the SSN"?

Put mindreading down as another talent, . I was taking it for granted that the EAD was going to be filed in order to do that and was hoping he realized that. BUT as a few ( VERY few) posters have mentioned that being employed was not a necessity for the incoming spouse, (LUCKY, ) so thought he might be coming from that angle.

THIS IS CORRECT. MY HUSBAND IS HERE, ON A K3 VISA. HE HAS TO APPLY FOR A WORK
AUTHORIZATION CARD WITH INS, IN ORDER TO GET A SOCIAL SECURITY #.

The following lists nonimmigrants, by alien classification, who are
authorized to work with authorization from INS. Employment authorization
must be shown on an EAD.

K-2 Child of K-1 (provision of law: 274a.12(a)(6))

K-3 Spouse of U.S. Citizen (provision of law: 274a.12(a) (6))

K-4 Child of K-3 (provisions of law: 274a.12(a))
