Default why do they make us wait?

hi all,

my husband had his AOS interview on may 19, all went smoothly, but the officer said before he can approve him we have to send him bank statements which we did, and the officer himself had to locate our I-130 file. my question is, how long should it take to locate a file and approve my husband? after all, he said he was approved.

You might be surprised at how long it can take them to find a file... just ask Heba. The USCIS clock and file cabinets are kept in the twilight zone.

Hi Linda,

As Marnee said, it could take a while! I think you can make an inquiry, though, after 30 days...you might want to schedule an Infopass appointment for after that time, just in case you still hear nothing....but I hope you do!!

Hi Linda:

Its of little consolation -- but to answer your question, it pays to remember that the whole basis of US immigration law is to keep people OUT but it allows for exceptions. "No" is built into the very fabric of the law and is the default mode. "Pending" is a lot better than "No." "Yes" is the best as far as YOU are concerned, but is disfavored.

hope you hear real soon.....where did you and your husband have your aos
interview..we had our interview on May 17th in Memphis on a Tuesday, and
he got his greencard on the next Monday.....keep up informed

My wife had a similar situation, her I-130 petition was missing from the case file at the time of her interview - it was somewhere en-route between the CSC and the NVC, I believe. I further believe, but cannot be sure, that it took about 2-3 weeks for it to get sent to the local office from whichever of those two - CSC or NVC - had it last.

Long and irrelevant way of saying that how long it takes may depend on where it is and why it's there.

I am kinda in the same situation but i had to send some documents and i got an answer from an officer at the local INS office the other day saying it could take up to 6 months i got very upset about the situation

hope they find ur case quick it is always good to make an infopass and go talk to someone there even if it doesn't help sometimes

hi brenda,

his interview was in indianapolis. i'm not really worried about it, but my hubby's kinda making me nuts. he's worried that when we go to morocco in july, they wont let him on the plane even tho his K-3 is valid until oct of 05.

As far as Im aware as long as his K3 is still valid he shouldnt have any problem returning with you while he is pending AOS as the K3 is good for multiple entries. Im sure someone will correct me if Im wrong on that one though.

Do you think Im being a little over presumptious to hope it might come about a month following Bio appointment??
Well thats what Im hoping for anyhow then it will just depend on how far in advance they see fit to mail letter with interview date

it sure would be nice if u could get an appointment letter as soon as a month after your biometrics. it took us about 2 months. and even then it was a surprise. i really wasnt expecting anything til about oct. around the time my hubby's K-3 expires.

Well wont be surprised if it takes 2 or 3 months but nothing like being optimistic once in a while where all of this is concerned. Not really in a hurry but cant wait for all of this to be over for at least another 10 years
