Default What Are Our Chances For A Positive Responce From INS?

I married my husband in early June of 2001. (Our baby just turned one
in october) Our story is this..when he first came to visit me,it was
in early November of 2000, he went back to England in January of 2001.
We couldnt stand being apart and he came back for another visit late
March of 2001, thinking he would have to go back to the UK and go to
school (we are both 21 well I will be tomorrow..we met on my 16th
birthday actually) in late June, BUT instead we got married. We
couldnt stand being apart and he would have had to go back very soon
so we rushed around finding out where to get married, they wouldnt let
us here in SC, he needed a Social Security card so we got married in
NC which didn't have a problem with us getting married at all and
things went smoothly. We were actually married in a prison in a little
room by a women who had to put out her cigarette first but it
couldnt have been more wonderful. Anyway the thing is,I don't
currently have a job but I am hoping to get one very soon. Is this an
important factor, since we were already married when we filed? What
steps should i be taking to assure him being able to stay? I am
terrified at the moment that they will say he must go back. I love him
so much no words could ever describe it,he is my everything and I
can't take the thought of him leaving, I couldn't cope with that it
would just be so very heartbreaking for us both. We hardly ever leave
each others side and we have never had even one small fight-we are
true soulmates. Any help at all would mean so much to me. Thank you
all in advance..

M.T.

PS: We filed in December of 2001,so we got in after the Sep/11 rush of
people filing. I imagine our papers are in some deep pile somewhere so
I am guessing it will take much longer than usual because of that and
all the changes being made to INS afterwards (which is okay with us,
if it means that more people will be caught before things go so
teribly wrong again that's fine that it takes longer and that we will
be looked at more closely because of all the new rules. It's just the
way things are now and we aren't bothered by it, it's a good thing.
What I AM wondering is roughly how long it will end up taking, not
knowing when to expect word is nerve wracking.

It may take up to 2 years in some places to get that "interview".

I assume he's already gotten his EAD/AP, SSN, etc. so he can work, etc. etc.

He came on a tourist visa and married later -- so he didn't come illegaly -- so no he won't be deported. They rarely deny marriage petitions to be honest. Worst case they may ask you to bring more proof and schedule annother interview.

Even if you fail -- just get a lawyer and appearl -- then the onus is on the IS to *PROVE* it's a fraudulent marraige. Rarely do they have the resources tod o that, so most people win in court.

Either way -- i wouldn't sweat it. Just relax and wait for the date.
