What is normally done if a K1 visa is rejected at interview?

Default What is normally done if a K1 visa is rejected at interview?

Just wondering. My fiance goes Tuesday. Everything is in order I believe. But I'm
wondering what is the procedure if it does get rejected? If some form is wrong, or
missing something, do they give you a chance to get it within a short time or do you
have to start the entire process over again? Do I, as her sponsor, have any options
such as calling the embassy or getting my congressman involved?

Again, I'm probably being paranoid here, but I want to be prepared just in case
because I haven't answered the question of "what if it's rejected?"...

I expect everything to be ok, but my fiance has to travel 12 hours by train from
Arad, to Bucharest, stay there in Bucharest alone (with her 3 yo son).. and take the
interview the next day..

any advice is appreciated

Jeff, you're no different from the rest of us!! We were all that way, at some time in
the process. Remember one thing. And remember it well. She can be rejected on two
grounds. One is if she is found to have some communicable disease like HIV for
instance, or a criminal record. If any documents are missing she will be requested to

yes that helps ALOT! She doesn't have any diseases, and her criminal record is clean.

so.. I'm hoping all of our records are in order

If you are not sure you are making enough, lining up a co-sponsor is best. I wouldn't
want to reach the interview stage and then find out. Yes, not making enough to cover
your affidavit of support could also be a grounds for denial. Go to:

Thanks for the last bit of info I think I make almost 300% of the poverty rate so
I hope I'm ok there

but that makes me think of another question... when we get married within those 90
days, then we apply for AOS... that's when we do the I-864 correct? So let's just say
we apply for AOS.. and get that... and after that.. I would get laid off.. what
happens then? Can they decide to kick her out of the country if in 2 years I lose my
job or I'm not making as much anymore??

Once your wife adjusts status to a US Permanent Resident (gets her Green Card) no one
will be checking up on your income anymore. You can lose all of your money and move
back in with your folks if you want. As long she does not become a public charge you

Neither the I-751 or the N-400 require any more Affidavits of Support. You can use
tax returns with your I-751 as proof of an on going relationship, but they are not
for proof of income. The N-400 asks for a list of your employers in the last 5 years,
but doesn't require that you worked in order to become a citizen, and does not ask
for any proof of income from anyone. Take Care. Shelley
