What is the difference between a K-1 and a K-3?

Default What is the difference between a K-1 and a K-3?

What is the difference between a K-1 and a K-3? I tried looking on the INS web site
and was totally confused. Can anyone explain it to me in a nutshell? Also, where is a
good place, besides the INS web site, to look for visa information?

in a nutshell, K3 is to bring your spouse to the US while awaiting the I-130
processing, K1 is to bring your fiance to the US to get married to you.

And a K1 visa is for Fiance(s)'s of US Citizens while a K3 is for the actual spouses
and their children (K4) as explained in the above FAQ.

K-1 visa is to bring your fiancee to the US. K-3 visa is to bring your wife
to the US.

A K3 is for immediate relatives, a K1 is for fiancés. You can only be eligible for one or the other.

They both require and approved I-129F non-immigrant visa petition, but the K3 I-129F must be preceeded by a not-yet approved I-130 immediate relative immigrant visa petition.

Once in the US, you must file for Adjustment of Status for both the K1 and K3. You need an Employment Authorisation Document if you want to work on both K1 and K3. If you want to travel outside the US with a K1 visa, you need Advance Parole to let you back in as it is a single entry visa; with a K3 visa, you can come and go as you please as it is a multi-entry visa (for up to two years, ISTR).

K1 is for the unmarried fiancee, gives you 90 days to get married when you arrive in
US K3 is for married spouse to let them come to the US to await processing of the I
130 Alien Relative visa look at: K1.exit.com
