Default We just got married....Now what?

We have all the paper works done

I-485
I-130
G-325A
I-765
I-864

All the documents, expect my husband's birth certificate and our
marriage certificate (both in the mail)

My birth certificate
Copy of my passport page with non-immigrat visa
2 natural color photos for me
copy of I-94
Employment letter form my husband's company
My husband's W2 from past 3 years
Color photo of my husband, and I

Anything else we are missing in the list?
Can some one help check it out for us.

I am a us citizen myself. My husband came to US as a student and over
stayed for about 2 years, he has been working for the same company for
about 1 year. His I-94 has D/S stamp and visa is good till 2006

Is he still qualify for adjustment of status?
What should we file when answering questions like
###what's your status now?### and expiration date?

Thank you

I would go to docsteen and kamya.com to get information and see filled out forms. Then I would have lots to read while I wait months, and months, and months...

Have you searched on google for keywords "I-485" "evidence", etc? The "groups" section has all the old archives from here.

The form instructions tell you what you need, but you need to make the connections for that person and have each submission stand on it's own. The attorney's here recommend sending anything you need to show any name changes, history, divorce and marriage certificates, copies of tax returns, 2 latest checkstubs.

You can say you are "pending adjustment of status", which is based on you filing the I-130 and them filing the I-485 with the G-325-A's.

You might want to get a consult from an attorney to find about your particular situation, especially with finding out how he entered the country and what might be in the database on your hubby. Provided he didn't do anything wrong to get here, or in falsifying anything to get a job, then they have to forgive out of status and working without current authorization for spouses of US Citizens, though it does tend to complicate things, especially post 9/11. Good luck.
