Question Visiting the UK as a US Resident

Hey,

I'm just wondering, once I've got my fiance visa and I'm a US resident, will there be any restrictions on me visiting the UK in terms of number of times a year, or number of days spent outside the US?

There are no restrictions but several things to keep in mind when a resident is that you spend enough time in the US to show it is still your principal place of residency. Also if you are considering US naturalization you must not spend more than 6 months of a year out of the US (an accumulation of 18 months in 3 years) if you don't want to restart your naturalization clock.

If you are going to be away for more than six months at one time, apply for a re-entry permit before leaving the US.

The US is not a prison camp. So long as you're spending substantially more than half your time in the US, you can visit the UK any time you want. As others have said, you only need to be careful is you get close to spending hakf your time outside the US.

Once you have your fiancé visa, you will enter the USA and then have to apply to adjust status to permanent resident (AOS). From the time you enter the USA using the K-1 visa until the time you get an Advance Parole (AP) document in hand, yes...there will be travel restrictions. If you leave the USA without AP in hand, your AOS will be considered abandoned and you won't be able to return to the USA until you start over and have an immigrant visa in hand.

Once you are a US Permanent Resident (after AOS is approved), and you have your green card in hand, then you can travel more freely. If you're just making short visits now and then, you should be fine. Keep in mind that you put yourself at risk of losing your US PR status if you can't prove your trip was meant to be temporary, and that your permanent residence is the USA.

The only time you can really travel completely freely, without risk of losing anything, is when you become a USC.

A few minor details. The finance visa is single use. Once you enter the country you have 90 days to get married. Once married you may apply for adjustment of status, as part part of which you may apply for advanced parole AP. The AP allows you to leave and return without abandoning you adjustment process. Once adjustment is complete you will then be a permanent resident I.e. greencard with which you are free to come and go as long as maintain residency in the US.
