Default Travel to Puerto Rico before applying for AOS

Ok, so I have a question regarding travel...

If you entered on a K1 and you haven't applied for your AOS, can you travel to Puerto Rico without an AP since it is a U.S. territory?

I don't have first-hand experience, but I have heard the answer is "yes, you can".

Yes. However, be very careful. If your plane develops a problem and you are forced to land elsewhere (Bahamas, Dominican Republic, Haiti, Turks & Caicos, etc.), you will very quickly find yourself in an immigration hell hole. Also, if you're on a boat, realize that you are travelling through international waters and if the boat docks anywhere other than PR, you may find yourself up the creek without a paddle... so to speak.

Hi:

The PRACTICE of CBP is to NOT treat this as a departure and subsequent "admission." This is consistent with long practice. However, this was based upon the old definition of "entry" and "entry" was abolished by the 1996 amendments.

We travelled to Thailand before we applied for AOS on my wife's K3 no problem at POE LAX.

Hi Glen,

The K3 is a multiple-entry visa and doesn't cause problems using it before applying for AOS. The K1, however, is a 1-time only entrance visa, and someone entering on K1 can't travel outside the USA and be paroled back into the USA without the AP document, which can only be received at the same time or after filing AOS.

K-3's are good for multiple entries. A K-1 is good for one entry only!

So the answer is "yes," but if anything unusual happens (eg emergency landing) you're pretty much ****ed. Ok, thanks.

yeah, lol. If you're stranded on a deserted island after your plane crashes, I imagine your immigration case will be screwed

Travel safe, Steffi & have a good time. Take a snorkel for me--I've been meaning to get out there for some diving, but sooooome day has yet to come!

Yes you can. However, you may be encountered by immigration officers along the journey so you should have your documents available in case you are asked.

My wife (K-1) and I went to Puerto Rico on our honeymoom and she didn't have
AP yet. We didn't have any problems. You don't pass through Immigration on
your way there or back. It's like a domestic flight.

Oh I'm not going or anything. *L* (Though that would be nice, wouldn't it!) It's just that someone on another board asked about it and I was curious about it.

Glen,

Irrelevant to the issue at hand.

But how did you like Thailand?
