Default Things to do things to do.. :)

My fiancé will be arriving here next week. We will be getting married as soon as we
can get to the courthouse, we just don't want to put this off, we can always have a
ceremony later. I'm a little confused as to the order of events. I see so many
variations.. I read somewhere that you can't work until you apply for AOS.. but then
I read you sometimes get some form at POE.. also.. I read that you can get a SSN
before doing any of this? Is there a list somewhere that shows the order in which
these things must be done, and/or the recomended order? I am not worried about my
wife working initially. I want her to take some time off and I will have no problem
supporting her but eventually she wants to work (in 3 or 4 months).. so. can she
apply for a SSN right away? My bank asks for a SSN in order to put her on my account
jointly.. do they accept people without SSNs? Also, will my health insurance cover
her if she has no SSN? I absolutely need her and her son to be covered on my health
insurance so that's another reason why we want to marry right away. How have some of
you handled these issues? Thanks!

ok i did find some of the forms..

I see another Affidavit of support. I understand I fill this out all over again

But what about the G-325 form? Do we completely fill out a new one again? I think
this would make the third time for my fiance (one for the K1, one for the interview,
and now this one)..

pictures... new ones again??

and the financial support stuff... my company just wrote a letter (stating my
employment, etc.) , my bank just wrote a letter (stating my accounts, etc.).. these
were in March.. If we marry in June do I need all new copies of these letters?

I have an INS office in Milwaukee, WI, which is only 30 miles from me... I found
their website but it's unclear whether I can file all this with them, or if I can do
it in person.. they say something about "if you filed your original claim in
Nebraska, then send it there"..

Ok. enough questions ..

Default and one last last last post I promise!!

Once we're married, and we've submitted everything for the AOS... are we ok? I mean,
what if they take 10 years (I know it's an exaggeration) to respond or set up an
interview..do we just wait?? And are we legal?

See the adjustment of status section, Doc Steen site. Enter-> get temporary EAD stamp
at the POE if you can-> go to SS office and get SS number-> if you did not get
temporary EAD stamp at POE, try at local INS office-> marry-> file adjustment of
status including application for one-year EAD-> get 1-year EAD card-> later have AOS

Yes, once one has applied for AOS, his status changes to "pending adjustment of
status", and he remains in legal status until AOS interview. Alvena

Suggest you go to the K-1 FAQ and follow it down to the entry and marriage and adjustment section. Spells it out for you.

BTW only your wife is entitled to a SSN, not her son. K-2's will have to get a tax payers identification number from the IRS for bank account and/or school forms.

Basically what you have to file is the I-485, I-864, G-325, I-765 and if they want to travel outside of the US, to return they need form I-131.

Ok thanks Rete!

When I apply for this Tax Payers ID, do I need that before I file the 485 stuff?
Should I get one of these IDs for my wife too if I want to get her on my bank
statement?

Your 2nd question:

You only need an ITIN for your wife if she doesn't have an SSN. (In fact some banks
will add her to an account without either when you are married, that is what I did
before I had my SSN, then when I had the SSN a week or so later we informed the bank
of the number). I missed the earlier part of the thread, but assuming you are getting
her an SSN then don't get her an ITIN.

I can't answer your first question as my K-2s are old enough to have SSNs.

Now I'm not really sure.. lol.. sorry.. but.. I wasn't planning on getting her a SSN
until we send in the AOS forms.. is this what I should do? I'm a little confused
now.. If I understand correctly, I can just go to any SS office BEFORE we send in our
AOS forms and just get her a number? It's that simple? The only reason I ask is that
I don't really need her to work right away.. there is no rush for that, but I want to
make sure everything else is legal.. and I don't want to miss anything...

Your wife is eligible for an number from social security asa she enters the US and before marriage as another poster in another thread about Miami pointed out.

If she doesn't get it at the first office, go to another and another until she is successful. She will definitely get one with the EAD.

As for her son, you can apply for it asa you are married I believe. You can d/l the form from the INS site. Some schools require a social security number for registration but will take the ITIN instead. He will be able to get one the moment he has his green card.

my husband and I filed at Milwaukee INS back in Sept 1999 (at their old location). At
that time they only accepted applications by mail - or in the drop box at the office.
Unless they have had a policy change I would recommend mailing the applications by
certified mail so you have proof of when they are received.

The main Social Security office in downtown Milwaukee (I don't have the address
anymore, but it is near the Federal Courthouse which is where the old INS office
was) was very familiar with immigrants applying for Social Security Card. Take

Ken waited 19 months for his AOS appointment from Milwaukee INS - filed paperwork
Sept 1999 - interview April 2001. However more recent posts are showing Milwaukee AOS
interviews are taking only 6 months or so - sounds like your wife will have her Green
