these ADIT photographs are driving me mad!
Hi again,
I'm posting about the ADIT photos once more to see if anyone can share any
information pertaining to these.
My fiance's face is a little long by 2 or 3 mm's and the width is perfect.
My face in my photo is about right in height, maybey 1-2 mm's short, and the
width is about 3 mm's less than the specs ask for.
So I am describing photos that are no more than a few mm's off in either
height or width of face.
I don't want to go back and do mine again as the guy who did them insists
that it is fine as he's done these for over a decade.
My fiance lives in Brazil and we are trying to decide if she should go have
the photo's done again.
Anyone think I'm close enought with the photos? Am I worrying too much
about these?

I'm an immigration lawyer practicing in Los Angeles. From the text of your question, I gather you are talking about the I-129F petition.
If that is the case, don't worry about it. The puprose of the photos on I-129F and I-130 applications is to prevent the use of "ringers" on the application. In fact, I've had several instances of where the photo from abroad was in face-on passport style rather than 3/4 view ADIT style.
If you were my client, I would submit the application with the photos you have AND request new photos from your fiance. If you should get an RFE, you will then be in a position to respond quite quickly. But it will probably be no problem at all.

Thank you for your posting and, yes, this is for the I129F petition. Your
response helped me to make the decision I was leaning towards which is to
stop worrying about these photos, which are close to what they want, and
send them in.
I wanted to ask you what a "ringer" is? I've never heard that term.

This is personal experience, NOT a guarantee, but my fiance's photos were somewhat larger than the specs (about the same amount as yours), and our I-129F was approved (TSC), and we got the visa (through London), no problem. I'm guessing you'll probably be fine--the worst they can do is delay the petition a bit if you need new ones, right?
