Tax Returns. Are They Really Necessary?

Default Tax Returns. Are They Really Necessary?

I've read many times on different forums that 3 years tax returns are
needed for K-1 affidavit of support, even though the official
(governmental sites) requirement is a 125% of poverty line. Does
anybody knows where this 3 years tax return info came from. Or, let
say, I was unemployed for year or two and than got a good job ($40,000
for example) this year. Is this sufficient for K-1? Please advise
anybody

You don't think CIS would just believe you if you say you meet the 125%
poverty line requirement without showing sufficient documented proof, do
you?
The government have to make sure you are capable of supporting the
beneficiary in your petition at the set standard and it is your
responsibility to prove it. You'd need more than just the tax returns if you
are chronically unemployed like that! Are your savings and other sources of
income enough to more than compensate for those years you were not employed?

Hi,

For the I-134, the three year tax return requirement is not a requirement on the I-134, but usually a requirement by the embassy. Some place, like London, are more lax about it, and even let the alien self-sponsor on an I-134.

Be aware, however, that 3 years tax returns ARE required along with the I-864, which you will do once the fiance is in the USA and doing AOS. If you are lacking tax returns for a good reason such as you were still in schoool, just explain that and attach it to the I-134 / I-864. It's your current income that qualifies you financially.

There are 2 distinct requirements (for the I-864):

Have sufficient current income
Provide your last 3 years income tax returns.

Nowhere does it say that those 2 are related in any way.

There is no requirement that your past 3 years' income be 125%+. There are a LOT of different financial scenarios that are approvable. For example, I wasn't working when my I-864 was approved, and I had not been for a couple of years.

If you are asking about your own specific example, if you had a good reason for not working the past 2 years (like you were in school) and you have sufficient income now, the CO can examine your entire financial picture and make sense of your situation. People in the situation described get approved all the time.

So what's your real question? I suspect it is 'will *my* affidavit of support be acceptable?"
Suggest you visit the group alt.visa.us.marriage-based and give your particulars.. the country/consulate you'll be going through makes a difference, as does your reason for no income for the past 2 years.

You can also use Capital to replace income.
