Strange Qs
This is for my friend.
" I came here on B-1 visa 2 years ago. I filed for extension 15 days before the expiration of my I-94. I was issued RFE to which I replied. But when I did not get any info from INS within 1 and half months after the expiraton of my i-94 I left US . Later on my company notified me that my extension was denied while I was in US ( a week before I left US) but the mail was not received till I left the country
I entered USA again last summer on H-1B visa ( got it from US Embassy in India) .
My questions : 1.Was I ever technically out of status?
2. Am I subject to 3-10 yr bar? ( even though I got a new visa (h-1B ) "

Yes, from the time the extension was denied.

No. You weren't out of status nearly long enough.

No. You weren't out of status nearly long enough.
