Of this I have no doubt. But you didn't answer the question. Would
you/could you take the case, either at that point, or after the alien fiance
arrived?

Paul:

It is extremely perceptive of you to note that I did not answer your question. Not only didn't I answer it, but I won't.

Yours is an interesting question about "the line" . I've attended quite a bit of MCLE [mandatory continuing legal education] of late including two hours of legal ethics. A lot of these things are not all that clear -- and does the word "Enron" ring any bells. One of the fallout effects of Enron will be some case law on legal ethics if not "reform" of the rules. Time will tell.

Soliciting advise. Here's my situation:

I am a Greek national that lives and works in the USA for just over 2
years on a L1 visa. The basic reason why I am here is my fiance, we met
3 years ago when I visited the US for business. We moved to Illinois
together, bought a house together a year ago and we are getting married
at the end of December. We were planning to come back and then do the
paperwork for me to get my status changed.

Well, you know what they say about the best layed plans. My company just
layed me off unexpectedly. I will be off their payroll in December, 2
days before we are supposed to fly off for the wedding and 10 days
before the happy event.

Now the situation is screwed up and I am not sure where I am standing.
How do I come back in the USA? Do we need to get a fiance visa before we
leave for the wedding or apply for a spouse visa when we get back? How
do we get back? How long does any of these procedure take?

We did not have to worry about any of this before so now I am a bit
overwhelmed. Any advice will be much appreciated. Any sites/info too.

Thanks,

Andrew
Yia Sou, Andrew & Congratulations on your wedding!

You are in *such* good luck. You as a Greek National are eligible to file DCF at the Athens Consulate (with your new wife) and return to the US on a CR1 Immigrant Visa within 35 days, possibly sooner.

This is what my husband and I just did; use google groups to read our story. If you begin your planning now and take all the documents you'll need with you, this could go quite smoothly, especially as you don't have a nasty *job* to hurry back to. If your intended wants to stay with you, she may, but she only needs to appear at the Consulate for the first filing.

When you enter the US, you will receive an I-551 stamp in your passport, which is the equivilant of a Green Card. No AOS, no further appointments with the Feds until you've been married for 1 year & 9 months.

Check out the DocSteen site (sorry, no link at my fingertips) and feel free to get in touch with any questions.

As you are already living in the US, don't bother with spouse visas or
DCF - you need to be living in Greece for that. And it takes a long
time before you can re-enter the US, it's really not worth your time!

Hey Des, I just want to clarify this as there is very little info about DCF in Greece available on the web....
You DO NOT necessarily need to be resident in Greece to do DCF. If one is a Greek National, the Consulate will do DCF for the USC spouse, even if he/she is not a resident there.
