About worrying, I have learned that it is better to use that energy you lose in worrying to try one thing after another. In the end, you will succeed, however many obstacles you face. A couple of tips:
I know it says that your husband was learning to drive so I assuming he doesn't have he's drivers license. But if he did have he's driver's license from England he can drive in the U.S. using that license. My husband is from Australia and he is in the exact same position but we just use his foreign driver's license. If not for that he won't be able to drive in the US either b/c of the whole SS thing. If your husband wants to work he should apply for EAD.http://uscis.gov/graphics/howdoi/ead.htm With that I believe you can get a SS# since he would need it to work and you can have him get a license through that method! Also whatever you do DO NOT go on Medicaid, Medicare, Welfare or anything like that. It look really bad on your application b/c it shows you will be a burden to the system. It's ok not to have any money, as long as you have co-sponsors who say they will support you it is not a problem! Also, STOP FREAKING OUT. The whole point of you sending in these forms is to have a Green Card interview where they basically ask you questions and try to verify if you are really married. SINCE YOU A HAVE (or are going to have) A CHILD, they will more than believe you have a valid marriage. If you look at other people's experience with their interview if they had a kid it was like 5 mins. So just CHILL! It's going to be fine! PLEASE, PLEASE, PLEASE get a lawyer. Esp. for Visa Waiver (which is my husband's situation too (I'm the USC)). to help you with all of the forms, I think carrying a child is a lot of pressure and your hormones are all over the place. I did my husband's immigration form my self but I was working a part time job and had 6 months to research it and fill it out. Just so you can take the stress off of you and to make sure it is done right have a LAWYER do it for you. the money that was wasted in a rejected application could have been money going towards a lawyer. You do not want to screw these papers up. If one thing is slight lywrong w/ your papers the INS will not process it correctly. So just save up the money and have someone do it for you. Also, I highly sugguest making sure you have a lawyer for the Green Card Interview as well since you came on a Visa Waiver. Not that it is an issue but it's just extra protection to make sure everythign goes smooth. HIRE a lawyer and don't freak out!! E-mail me if you have any questions! However, the US, like many countries, issues a landing card to anyone who is not a citizen or a resident. The US variety is called an I-94, and I suspect that this is the thing you have lost, as they would staple it in the passport. There is a form to fill in to get a substitute I-94 to replace a lost one, so don't fret about it, just fill in the form and get a new one. |

hello,i have got some sort of good news,i think...news from the nh office which seems very positive...odd since it seems unrelated to aos...sent what they wanted so we will see how things turn out??? things look a BIT up and in our favour..still looking into getting a lawyer...thank you to all who have responded and provided important info...means a lot to us both and i think we are feeling more encouraged about the whole thing since our letter but like i said i need to confirm everything is currently go...i assume they wouldnt send us a paper about medicals exams and interviews if they had plans of deportation surely!!?? anyway this post is a bit scattered but i am yet again up very late..what im trying to say is theres some sort of flow actually going now and it seems like pretty calm waters to us..bit easier to ride thats for sure. anyway everyone take care and perhaps soon i can get everything sorted perfectly and can give and honestly wonderful update...one meaning we dont have to go through too much hassle after all..

Might also want to call local area law schools and ask whether they have immigration help center. OfLoveAndFears, please consult with an immigration attorney. It's likely that your best strategy is to file Forms I-130/I-485, and either let the other I-130 go, or perhaps withdraw it. If the I-130 you already filed is approved very soon, your spouse can file the I-485 with the approval notice of the I-130. No offense intended, but your attitude always seems scattered. I think you should move quickly on hiring a competent immigration attorney. |

ok not really sure what others said but it all seems like "call a lawyer" i'm sure you cannot afford one, so here goes.
first look at this link, it will tell you exactly what you need to do http://uscis.gov/graphics/howdoi/LPReligibility.htm#a also once you have all the correct paperwork ready go in person IN PERSON, to your local ins/bcis office and file, at the moment the financial paperwork needs do not have to be met, but they do need to be filled out, i know stupid but thats ins, you will however need to meet the requirements by your interview date. what i am telling you to do it adjust his status, not sure if this question was answered but no records are kept of the i-94;s, no really even with all the terrorist threats.... but they may have a record that he had one. even if he doesn't have it its not too important, there are a lot of things your told you need which you don't the most important thing is he is here in the usa, that does alot for the process. Sorry if this is all so vague, but theres a lot of info, I also do know what i am talking about, i did not use a lawyer, but i know more than most lawyers or ins officials, as i've studied the ins law and policies for 4 yrs now, plus i went through exactly what you are now. if you need more help here is my e-mail address i'll answer any and all info you need i know how crazy this situation can be but don't feel overwhealmed, one other thing YOU can claim benefits but your husband cannot at all under any circumstances, so you can get medicaid. I was assuming that she withdrew that and refiled I-130 & I-485 together but I should have realized that there wasn't enough time to be receiving interview appt. if she has refiled I-130 and filed I-485 as well. She definitely should let an immgration lawyer handled it ASAP. OfLoveAndFears, after reading some posts here where people got their paper stuck for even simple procedures like mine, I am spending money getting an immigration lawyer. A good one would know what should happens at each step and would realized what actions to take if something is not happening. I strongly suggest that you get a lawyer NOW. |

we just got our aila ref. via email so will be calling this lawyer soon.. i hope he is a good one who can help us because we will be on the lookout for someone who cares,knows what theyre doing,and will help us...so this is a possible way to go for us,contacting this guy...hmmm...heres hoping...anyway still trying to sort it all out but with good support (ie helpful and caring messages here,info from official websites,and phone calls that i hope dont lead us down twenty paths all of them wrong (picture much eye rolling here..)) we will get through all this...seems rough and theres been a lot of confued information (did i mention its not our fault? yes i say i feel stupid here but i also sort of feel ive been made to feel stupid,in a way...i have to say we personally have done all we can do and have gone about everything the right way as for who we have contacted,how we filled out our forms...but everyone has said something different from everyone else...so im actually feeling better about j and i working through this..we didnt make mistakes,the only mistake we made is listening to people who were supposed to know the right things...soooo once we DO have CORRECT info in our hands i know we are perfectly capable of getting it all filed correctly and from what i know he has an excelent chance of being able to stay,i can think of no reason otherwise..)) so...onward we go from here....still a bit scared but that comes with it..as long as i can honestly tell myself and j that things are going to be able to be worked out soon and in our favour then its alright.. |
