Questions Regarding Marriage To A Foreign Student on a F1-Visa about to graduate

Default Questions Regarding Marriage To A Foreign Student on a F1-Visa about to graduate

Hello,

Perhaps this group can shed some light on some of these rules forms
etc. I've been exhausted trying to make sense of everything needed
online.

I am a U.S. citizen and gainfully employed. My fiancee is a student
in the US already and in legal F1-status abotu to graduate. We are
getting married next month.

I have been workign to line up jobs for her but of course she can not
work. I'm trying to learn the steps involved in getting her a petition
to work after we obtain our marriage license. Which of course is under
the 2 year marriage rule.


So essentially here is what I'm trying to figure out. The forms I need
to fill out the paperwork she needs.,that I need to accomplish this.

What two year marriage rule?

The process is pretty straightforward in this situation. You file and I-130
at the local INS office and she, concurrently, files to adjust status
(I-485) and to get employment authorization (I-765). Note that the
employment authorization is based on the adjustment of status application
*not* merely being married.

I'm guessing that the "two year marriage rule" you have heard about is that
if she becomes a permanent resident less than two years after the marriage
it is conditional and she must apply for the conditions to be removed two
years later.

I went this route and it's fairly simple. Once married, she will need to
apply for adjustment of status. She can send in her employment
authorization at the same time. Depending on where you live, she may get
employment approval immediately or it may take a few months.

Do not let her leave the country (after the wedding) until you have filed all the adjustment of status (AOS) paperwork and then filed (and received) an Advanced Parole (AP) document.

This is a common mistake people make, to think you can travel out of the US when adjusting status. If she does, she may not be allowed back in.
