question on form OF 156K
Hi, Folks. My fiance and I are wrestling with packet III at the moment and we
need a little help. I am the USC, he's in Peru. The forms he received are in
Spanish. Question 14 of the form OF 156K is phrased in such a way that the
exact translation of the Spanish is "Have you ever been denied admission to the
United States during the last 12 months..if yes, explain" I've noticed that
the English version is more specific about "admission" saying things like "at
the port of entry" etc...but this form does not. So, if my fiance tried to
obtain a visitor visa but was denied, then was he denied admission? Or are they
only talking about at the border? Also, if he ever applied for a lottery visa
and didn't receive it, is that considered denial???
All help appreciated...thanks!

Since the consulate will know either way if he was denied a tourist visa, I
would recommend that you check Yes, then explain that he appled for the
tourist visa, and was denied. There will be no problem. If you put No,
there is a slight chance that could be construed as fraud.

I don't have the form in front of me. But I would rely on the English form as the controlling one.
The visa denial will be picked up by another question -- the one about visa applications.
So the admission one can be answered as "no"
On the visa lottery -- if she simply made an "entry" in the lottery and was never picked -- that will be picked up in the question about visa petitions and indication of intent to immigrate -- there you say "yes" and describe as "DV entry" made in and give either the applicable FY or the actual year submitted followed by "not selected."
This way, you have been honest, upfront and it will cause no problem.
