Prenuptial agreement and AOS interview would it be a problem?
Hello -
I am a US citizen and I am married to the person who does not
have a green card. We sign a prenuptial agreement before the marriage
and applied for a Green Card.
Can this (i.e. existence of the prenuptial agreement) be an obstacle
in any
way to my wife's obtaining a Green Card through marriage?
If anybody who has been through an interview can remember whether
there were
any questions about this, please share this information. And anyone
was denied due to this? We applied in NYC.
I would appreciate any input on this.

No. As long as the affidavit of support is produced I don't believe
USCIS care that you have a prenup. Whether you would actually be asked
about it I don't know but I tend to doubt it

USCIS care that you have a prenup. Whether you would actually be asked
about it I don't know but I tend to doubt it

Ben,
What causes you to suspect that a pre-nup might be a hinderance to adjustment of status? I would think just the opposite - it's an indication that some thought went into the marriage as marriage rather than as a route to a 'Green Card'.

Sheila and I had a prenuptial agreement and it made no difference whatsoever. Indeed, it has *never* come up as a topic in any of my dealings with USCIS.

It may depend upon what the pre-nup provides for. However, in general, I don't think that evidence of the bona fides of a marriage hurts a case.
