Please, HELP. Living apart while I-751 is pending!
To the Newsgroup:
My husband and I sent the I-751 (removal of conditions) a few days ago and received
the receipt that extends my greencard for one year (by the way, the approval will
take at least a year!). The problem is that we will have to live separated for a
couple of years because I will be going to school in another city. My husband tried
to transfer with his company where I will attend school, but it didn't work out. I
will have to move out in a couple of months. At least, we will be in the same state.
Do you think that is going to affect our I-751? Do I have to notify my change of
address to the INS, despite the fact that the majority of my posessions will be at my
husband's place? The school I will be attending considers my school address as a
"local address", and my husband's address as the "permanent address", but what about
the INS? Has somebody been in a similar situation? What should I do? Any comments
would be appreciated. Thank you!

If your husband is staying in the same place as you occupied together, then you don't have to do anything. The I-751 in all likeliehood will be approved without an interview and INS does not have to be advised of your change of address. I'm assuming since you will be a student that you husband will still be working to pay the bills, receive the mail, etc.

Why not just keep the information to yourself, about being in separate addresses? To
all intents and purposes you are a genuiune married couple. Just keep all your
documentation in order as prescribed for removal of conditions. Mainly co-mingling
of finances -- joint bank accounts, lease agreements, mortgage statements etc. with
both your names. This is the kind of information they are looking for. You should
make an extra effort to keep your documentation in order in case you do get called
for an interview. Take photos of yourselves together on vacations etc. I'm sure you
spend lots of time together during your breaks from school and during weekends etc.
Apart from that I wouldn't inform them of any change of address and confuse the
issue. Ranjini
