Default Permission to stay in US until divorce?

Hi everyone,
This question is related to a question I posted before, about the woman who wants to divorce her US citizen husband and return to Russia. Her divorce attorney is not knowledgable about INS rules.

The initial interview with INS is scheduled for mid-January, 2003. If she has not finalized her divorce by then (which is likely, if the husband contests the divorce), how long is she likely to be able to stay in the US. Her goal is just to get the divorce and leave.

Is there some procedure for her to get permission for staying temporarily to accomplish the divorce?

Does this situation suggest any other issues to be considered?
