Hello,

I tried to serach on USCIS.gov but couldnt really find a clear answer. Does anyone know how long it takes for spouse to come if a permanent resident on Green Card applies for her spouse who is outside US?

Hi Sanna,

No one can predict for sure, but we're talking years here...I'm thinking from previous posts, maybe 5+ years. But, during that time, when the PR becomes a USC, the case gets moved up, and gets processed more quickly because now it's a USC applying for a spouse.

Although, USCIS process dates for VSC say they are processing I-130's for PR's applying for spouse, from Oct 2005. So I'm not sure now. I thought it took longer than that.

You've gotta have your number come up for the visa first. So the date the processing centre is working on is pretty irrelevent.

What nationality is the spouse, and what is his/her status in the US?

AFAIK, said spouse would have to maintain status independently until the GC holder's petition for him/her is approved.

No EAD because she can't adjust if you're a GC holder. If you're a USC, it's totally different!

He is on H1B here from INDIA, and spouse is GC holder in the US, so what would be the process say if applied in Oct2006, I mean what would be the status.

Applied for what?

He has to maintain valid H1b status until his priority date for filing for marriage-based AOS is current.

Don't understand!

Two people, one on H1B and the other with GC. So they can both work anyway, the former in a somewhat restricted category and the latter wherever s/he wants. If they get married, this won't change.

The H1B holder's status would be H1B. The PR spouse's status would be Permanent Resident. That would be their status until the PR becomes a USC and file for the spouse's AOS....or until the H1B holder gets his own PR status.

At the minute, USCIS appear to be improving their wait times quite dramatically. No doubt the wait will still be longish in this case PR applying for spouse, but it does appear they are getting their act together over a year or two ago.

I am not sure what you mean? Are you saying that its sooner than 5+ years (thats what I thought and Noorah said...)?
