Probably, but the US regulation says that the military person has to get permission to marry, implying that without the permission the marriage might not be recognized. Under the circumstances, if there is such a rule I doubt the US would care.

Again, this has nothing to do with US immigration. It's an issue for the UK military... so that's where the questions should be directed.

Your fiancé needs to ask his CO whether or not he must be discharged before a petition can be filed.
