Over 6 yrs, h4 to h1 question
Folks,
My wife, in her seventh year of H4 visa status, will be completing her BS studies in few months. My question is that will she be eligible to work in USA after her getting her US undergraduate degree.
Yes, our labor certificate processing is presently ongoing , however due to slowness in that process, we are at least 1.5 years away from I485 etc.
Thanks for your time and please reply..

Unfortunately, I don't think she would be eligible. She can get a
seventh year H-4, but changing to H-1B, I don't expect to be possible
because she does not have an LC pending herself.

And because of the quota, probably even further away. I would be
surprised if the quota backlog didn't hit everybody fairly soon.

Thanks Ingo, Great to have you around...you are an old helping person around...I recall three years back when I was in real troubled times, you provided me lots of support.
This time it is not that bad an issue...
