NYC AOS Pending -26 Months

Default NYC AOS Pending -26 Months

Hi there,

Hopefully someone can advise me what to do in my case:

Filed AOS on May 21' 2002 and since then i have gotten 2 employment
cards and
am due to apply for 3rd card now. It is almost 26 months and i have
heard nothing. I dont even know if my case have been transffered to
NBC or not??

I keep reading these postings and see that almost everyone who had
filed around or even after me has received their
fingerprinting/interview date.

Can someone please help me and advise what should i do. Do you think a
trip to local NYC district office will help???? (at least they might
tell me if it was mailed and the mail got lost). I did move once and
got a confirmation from them about address change and received
Employment Card and Advance Parole at the new address . So i am
assuming that they did change the address in their record.

Please advise me if i go to local office , they might be able to give
me at least some information.

You're not the only one who has no clue on what's going on your case.

I, too submitted on February of 2002 but until now I haven't get any letter about the interview. It's very disappointing that people who applied just last year have gotten their greencards before us.

The way I see it you have three choices:

1. Sit and wait;

2. Go to 26 Fed Plaza and request information directly; or

3. Contact your political representative's immigration liaison and have them do an official inquiry into your case.

Hi there,
Did you try going to 26 Federal Plaza and find out about your case???
I am planning to go coming Wednesday (14th of July) and shall let you know
what happened.
Also i did try taking Infopass appointment online and i got it for Wednesday.
I am not sure if they will honor it but i will give it a shot and take the
printout with confirmation number and a bar code.

Thanks a lot for your advise.
Have you ever come across people who are waiting for more than 26
months at NYC office??? or my case is an isolated case.
In short, is it time to be worried or 26 months at NYC is a common
thing???

There have been a lot of cases in the past for AOS that go a long time. Generally the excuse is that they haven't got your FBI check back yet. Some FBI checks take forever and I would be following it up at this point.

First see if you can find out why it is taking so long. If its an FBI check then you need to follow up with the FBI. I'd get your senator / congressman involved at that point to help you with contact information etc.

We waited 21 months back in 1998 and I see posters who filed in 2002 still wondering what is happening with them while filers under the new procedure are seen and approved already.

I would not be overly worried if you haven't moved but I would check it out if it were me.

Your input is appreciated Cman. I see that you are new to the newsgroup and wonderful where you get your information?

If you had read the original posters post, you would see that he has NOT had an interview for AOS yet and that, therefore, your reasons why are irrelevant. That excuse is only if during your AOS interview the examiner claims not to have your security check back. And for the record, it is not just the FBI but the FBI, CIA and IBIS which will check your fingerprints and your name.

Sorry, I am not familiar with how the AOS security checks are done on cases filed at that office and how they affect the scheduling of an interview. I just know that there have been cases where the approval is held up prior to the interview and this has been the reason that they gave.

I guess they must have just lost his case or something.

I know there are many cases where the interview is scheduled prior to having all of the security checks back but I thought that was an oddity and not the norm. Perhaps if the person having the checks done thinks there is an issue he doesn’t schedule the interview? I don’t know but would be interested to find out the reason why its been delayed.

Interesting, I never have heard of it and welcome anyone else who has to step forward and affirm this. Would be another kernel of information to added to Steve's FAQ.

I believe security checks are handled the same way in all district USCIS offices. One goes for fingerprinting/biometrics, the prints are cleared with the FBI, then there is the CIA check and then there is the IBIS name check. If there is a hit on any name further investigate is conducted.

All to many regulars of this newsgroup have found that they have been called in for their AOS interviews only to pass the test but have final approval withheld pending security clearance. So it would appear that district offices of the USCIS throughout the US are conducting interviews regardless of results or lack of results of the biometrics and name checks.

Not necessarily. NYC District Office is currently processing at over the 2 year mark. he is still within the allowable timeframe for adjudication.

I am sure he is as interested or more so. As NYC USCIS is not user friendly, he might just receive the generalized answer, your case is pending. In that case he should be all means conduct a political rep and have their immigration liaison inquire on his behalf.

Well, just because the USCIS used it as an excuse it doesn’t mean it was the reason I suppose. I have been reading letters posted to senators and congressman and reprinted on USA Today's web site. Thats where I got this tidbit from.

It seems the interview is just part of the approval process with AOS. I think if one were to add a dependency for the security checks being passed prior to scheduling an interview, then things might be a bit more efficient. However, It doesn't seem to have worked out very well for the K applicants.

Hi Bharat,

I'm in a similar situation - filed in NYC July 2002 and no interview
letter yet.

I was wondering how your infopass appointment went. Were they able to
tell you anything useful?

Yes, they'll honor it. They have to. I can imagine the riots if they brought in this new fangled system and didn't even stand by it.

My wife and are in the same boat. Filed 485 in NYC:Federal Plaza on
August 15, 2002, time expiring on 2nd EAD, still no news on interview.

Do update us after your visit to Federal Plaza and good luck.

Aye, that's the crux of the matter. Those of us at or approaching the
two year mark but without interview appointment have a dilemma
regarding a third round of EAD and AP applications: (1) Not to apply
for a new EAD / AP, expecting the interview in time, but taking the
risk of not being able to travel or work legally; (2) Apply for a new
EAD / AP to be on the safe side, but taking the risk of wasting $340
on documents that will be useless if the interview happens in time.
