New procedure for AOS via NYC district office !? READ !!!
Hello everyone,
As I posted before my husband (a K3 Visa holder) sent the AOS application to NYC district office on 10-4-03. We were expecting only to receive the infamous "little yellow receipt", but guess what.... Yesterday, in the mail we found 2 I-797 Notice of Action letters. One addressed to me, for the I-864 affidavit and the other in my husbands name for the I-485. His I-797 gives instructions for the biometrics appointment. An interesting point is that the receipt number begins with "MSC-xx-xxx-xxxxx". Does this mean the application was forward to Missouri Service Center (they handle the K3's)??? Also, a notice was attached claiming a new procedure. It states that in an effort to improve their services, BCIS has forwarded the form identified on the enclosed Receipt Notice to this facility for processing. But what is "this facility"??? I am guessing MSC??? When I checked the status online it states 120-180 days for processing. Can this be right? ~Claudia |

Yes, MSC is the Missouri Service Center and I believe it is also called the NBC National Benefits Center. Mr. Folinskyinla wrote to advise of us new procedure which would be taking place a month or so ago. So no big surprise to many of us here on the forum.
Glad to see that NYC is actively participating at the moment as it might well prove to unclog the backlog of AOS, EAD and other sundry petitions lanquishing on the shelves in the bowels of 26 Fed Plaza. Just to let you know that i have been waiting for AOS at NYC BCIS since August 2001!!!!!!.
i would assume that the paper on my file is starting to get yellowish. If they are expdiating the new application what's gone happen to the old ones like mine? Frustrated can't help it. Thanks all. |

Yes I am familiar with the many posts you have started the last two weeks in regards to your NYC DO plight. As others have suggested to you, now appears to be the time for you to either: 1. Hire an attorney to sort through the issue; or 2. Contact your political representative and have their immigration laision look into the issue; or 3. Go to 26 Federal Plaza's 3rd floor information desk and find out what is the problem. I know that you are also looking for a quick advance parole from this DO. Rete |

Rete This is wonderful news!!!! Does this mean that the AOS will be processed in 120-180 days? (Really doubt it). I can't believe it, we are truly lucky. I checked out some sites and the processing for NBC (MSC) for 1-485's was April 2003. WOOOOOOOOOHHOOOOO. I don't want to seem selfish, but I'm soooooo happy. We thought we were look forward to at least 2 years, what a relief. ~Claudia |

This strikes me as a teensy bit unfair - would it not have been more equitable for the local offices to offload the old pending cases rather than the new ones? I filed AOS with NYC on 4/19/02 and at last count NYC BCIS were taking 2+ years. As it stands right now I would be better off abandoning my original application and re-filing it with MSC! I would get it faster! Sorry, just railing against the wind. It just bugs me that due solely to my geography, I have to wait 2+ years and apply for at least 3 EADs and APs along with their concomitant fees. Their inefficiency will have cost me an additional $500 in filing fees, photos, mail costs etc. by the time all's said and done. Meanwhile, just across the river in Newark you can basically get AOS in the time it takes to make a cup of tea. At least one of the 'benefits' of NY taking over 2 years to process AOS was that you would get the unconditional green card. You watch... now that NY has offloaded new cases to MSC I *guarantee* you they will speed up processing just enough to ensure that my interview date is 1 year and 364 days after filing. How exactly does that speed up the process of "ultimately... the whole [AOS] package?" What exactly does MSC add to the AOS process other than a round trip mail ticket for your application between the local office and NBC? For example, I filed AOS Apr02 with NY BCIS. My latest EAD and AP applications were forwarded to and processed by NBC. They seemed quite capable of processing the EAD and AP despite the fact that my AOS app is physically sitting in Federal Plaza collecting dust. If the policy now is to send the whole AOS app to NBC, what exactly are NBC doing with the AOS portion? Are they just processing EAD/AP and then sending the AOS portion right back to the local office? Do they do ANY processing on the AOS app at all? Data entry, IBIS checks, fingerprinting, anything at all? Very confused.
