Default new to this, need some advice

Hi all,
I have been reading your posts. Oh my. I am new to this, and now i am soo
overwhelmed with information.
I will start here first. but seems though this NG is basically canada,
london, usa related. but anyhow..my bf is in malaysia. we want to marry but,
we don't know how to go about it. First of all, we have not met in
person..first problem with a k1. secondly, if i fly to him for the 'meeting'
and get married there, what would be our next step to come home to usa.? Is
it a forever wait for him to get a visa? and what visa would it be?
am sorry for all the questions but like i said, i am confused and
overwhelmed with soo much info.

Kristy,

I just replied, but I am not sure if my reply went only to you or to the
group as a whole, so I will repeat it.

First off, almost all of my answers have come from the website at
"k1.exit.com". If you go there and marry, your options are only the IR-1
Spousal visa with the possibility of his coming here in a K3 nonimmigrant
visa.

The wait time for K3's is pretty standard because they are all filed in the
same way. You start by filing petition I-130 with the appropriate service
center (this IS the forever wait!!!!!!!!!!!!). You then receive Notice of
Action (NOA) 1 from then and then you can file form I-129F at a specific
Chicago address and then Chicago forwards all K3's to the Missouri service
centers. Therefore, there is NO variability in K3 processing times, they
are all dependent upon the speed (or lack thereof!!!) of the Missouri
servcie center.

Your have other possibilities as outlined on the website, but the most
likely only other one is the K1 fiance visa wherein you would NOT get
married there, instead, getting only engaged. Additionally, the website does
not and likely cannot provide information about the relative processing
speeds of the various Service Centers. Thus, pursuit of the K1 or K3
option, however, should take into consideration the relative processing
speeds of the Service Centers (which is likely always changing). Currently,
Vermont and California are the fastest and are faster than Missouri. Texas
and Nebraska, however, are slower than Missouri, so if you are stuck with
them, you might consider the K3. Directions for which service center you
would need to use are located on the I-130 and I-129 F forms.

A final note. Your wait is likely to be longer than you want no matter what
you do. I've applied for the K3 and am in Day 114 of waiting just for the
petition approval!!! Also, there are innumerable variables that affect the
waiting time, almost all of which you have no control over!!! If you pursue
your relationship, be ready to learn about patience and lack of control over
the process!!!

Thank you for your re.
*sigh* lol.
I am from illinois so i think i seen that i would use Nebraska, but will
have to check for sure. I will go to that website u indicated and check it
that site out as well.
day 114 and still no approval for even petition. omg good luck to you as
well.
i need to learn patience anyway, so what better way than this!!!! I am not a
very patient person:P, but when it comes to my love, i can learn it. Thanks

I'm afraid so......Illinois will be Nebraska. My fiancee is the US citizen, she lives in Illinois (as do I now!) and we filed in June 2002.........approved early November (K1 route.......fiance..... of course). Thats pretty standard. One thing though, and this could slow you down even more, you wont be able to file for a K1 without considerable evidence of meeting in person. Since you havent yet, thats more time to add to the process. Sorry to be so downbeat. All I can say is..........its worth the wait....

My first suggestion is don't marry him after you meet once. You need to
develop a deeper relationship than that for a successful marriage. There
are many foreign men who would just about kill for a US visa....and
would get it any way they can. You want to be sure that this is the
"real thing," and that you are not just a "US ticket."

Another comment I would make is that if he is of a different religion,
you need to be sure that you can acclimate to that. Do not expect that
he will change to your religion, that probably won't happen. It may be
that, additionally, he will be subject to greater scrutiny by the FBI
prior to being issued an immigration visa, due to his location in the
world.

Thirdly, is he employable in the US? That is, how is his english, and
does he have a trade/profession? If not, you could end up supporting
him.

Perhaps I am painting a worst-case scenario, however these are real
issues that you need to have resolved before you get in over your head.

Thank you for your input. I do understand you point very well, and agree
with you 100%. alot of them are looking for a way to get here. lol. I liked
how u put it. I will keep ur suggestions under great advisement. thank you.
Yes, he employable in US, at least I think so. He has master's in computer
applications, BA of arts with math and statistics..and is certified C
professionl. So in my opinion, he can find a job somewhere...
Yes, we understand the scrutiny part of the FBI, which is ok with us, we
expect it!!!!! if fbi would have done their job a few years
ago.......well...i need not say. Thanks again for being objective, not in
effect painting a worst-case scenario. Need to be realisitic about all of
this!!!!!!

Yes, we have tried to meet in person in the past, but in the end it seemed
everything worked against us. We have known one another for 3 yrs now, and i
think if we can wait that long....alittle longer won't hurt.
your not being downbeat..just truthful congrats on getting here........it
is cold here now huh??? lool
