Default need sum advice/uk gf

hi everybody, jus ran into this website not so long ago
Any advice will be greatly appreciated

My gf is a UK citizen, and im currently trying to help her out. Right now shes with me in cali on a VWP ( Visa Waiver Program ) shes only here for 90 days. She really likes it here in cali, we're both desperately trying to seek out options that will get her naturalized. Althought i recently did get my US citizenship i cant marry her, its a "gay" relationship. SOrry for all those that are offended
carrying on, I looked into the student exchange program but it just didnt work out. I guess the only option left for her is either she gets married or gets sponsership?

Im feeling a bit uncomfortable with the whole marriage deal, theres to much to risk if its a false marriage, so i dont think we will go that route.

Does anyone know how long the sponspership process takes? I think I have a friend who is willing to sponsper i just need sum in depth info, theres not much i can do, im only 17, shes 19. Does she have to be in the UK while her paperwork is being processed? etc. How does it all work, i know its a lengthy process especially after 9/11 occured, my family in the US sponserped my family and another family as well.. when we were living in india, it took nearly 2 years. I just hope she can stay here while all the paper work gets processed.


we also thought about her staying here for the 90 days and then going back to the UK, for about a month and coming back again and doing this a few times but i do know the USIC officer will eventually deny her entry if it is happening to often.

Sorry, but I can not see that you have any other than that the UK does recognise gay partners for immigration, the US as you no doubt know does not.

You can not sponsor someone, I am assuming that you mean they provided an affadavit of support for someone who had another reason to be able to immigrate.

But that's neither here nor there. So here it is again a very very basic list of ways in:

There are basically SEVEN ways that you can get a visa to live and work in the US:
(1) Marriage (or engagement in anticipation of marriage) to a US citizen.

(2) You have skills that are in short supply in the US e.g. scientific or medical training. A degree is normally a must. Or you have superior specialist skills with at least 12 years experience.

(3) You have an Employer who is willing to transfer you - but even the employer has to make a good case for you - so you have to be a manager unless you fall under category (2) above.

(4)You may get a Green card in the diversity lottery (UK citizens, except N.Ireland are not eligible)

(5)You own or buy business (does not get you permanent resident status i.e. no green card)
The business must have a minimum value of around $100k (more the better) bearing in mind you will need somewhere to live and with any startup business you will need at least 2 years living money as back up. So a figure of $250k would be a nearer minimum

(6)You are an "investor" i.e. you have at least US $1m in assets to bring with you. And your background will be investigatedto the hilt.

(7)You have a close relative (mother, father, brother, sister and no further) who is an US citizen who would sponsor you, approx time this take 2-12 years…

Recruitment agent will not take you seriously if you are not already in the US. Writing for jobs is really a waste of time; likewise US employers have no idea what foreign qualification are or mean (except Degrees) it may pay you to get your qualification translated into a US equivalent, there are Companies that do this ..
But if you are getting a visa under (2) above then you need a job offer before you can get the visa. Your Employer will be your sponsor this will cost them upward of $3k. So you can see you have to be offering something really special to get considered They may also have to prove to the Dept of labor that there is no American who can do the job if the position is to be permanent

What kind of sponsorship are you talking about? She needs at least a USC
sibling to get sponsored and that takes more than 10 years.

Employment-based sponsorship is even more difficult, and considering her
age, almost impossible.

However, she can study here and if she studies in a specialty field, she may
be able to find an employer willing to sponsor her for an H1b and even a GC.
Nursing comes to mind as a good field to explore due to the current
shortage, but you are still looking at a very lengthy process (many years)
and a major expense (tuition + cost of living)

Sorry I don't have better news for you :-(

The USCIS does not recognize gay marriages, so that's out. H-1 is out since it
cannot be possible that she has a bachelor's degree or specialty skills. She
can look into an unskilled worker category to get a green card, but that would
take years. There is no quick solution to permanent residence.

yeah i figured, but does anyone know how many times she can do this VMP deal.. bc i know for sure that she can do this for as long as she likes but theres really no time period that i know bout that she should wait before comingback to the US again.. this is wat ive found ;

"There is no limit to the times you may travel Visa Free under the visa waiver program in any given period of time. THere is also no minimum period of time you are required to remain outside of the U.S. before re applying for admission. However, if you are a frequent travel to teh U.S. you should be sure to carry w/ you for presenttation to the U.S>. immigration evidence of your residence abroad to which you intend returning at the end of your visit together w/ evidence of funds sufficnt for your support while in the U.S. if office of the USCIS is not convinced that you are a bona visitor for business or tourism, you can be denied entry"

^ i understand all of that and its self explanatory, i also called the INS office and asked bout it and she suggested my gf to stay in the UK for about a months before coming back here again, but i jus wish i knew how many times she can do this.. i know she'll be stopped eventually.. and to add to all this.. how do you re apply for this process... bc she didnt have to apply for anything i think ti was something to do with the type of passport she had and it didnt require her to fill anything out.. and she got was a entry stamp, is it different if shes coming back here again? just curious.

She might be able to get away with (mis)using the VWP that way a few times, but pretty soon the immigration officers at the airport is going to notice the obvious pattern, refuse her to enter the US on the VWP again and from then on she will have to get a tourist visa from the embassy in the UK whenever she wants to visit the US. The VWP is a privilege, so to abuse it would not be very smart as it's bound to cause problems down the road.
